      I am having issues with this management company due to them being unresponsive, rude, violating my owners contract I have in place with them and getting maintenance done on my properties that was unauthorized by me and billing me for it. They also hold my rent which they receive from my tenant on time for up to a month and claimed it was used to pay of maintenance fees which were unauthorized by me as the owner of the properties. I have tried several times to mediate with them and email them or call they are unresponsive to my calls and very rude whenever I go to the office and kick me out. Funds owed still as stated in the email I sent them is the following. After further review of my statements and contract the following needs to be refunded to me as soon as possible. In reference to the property on ***** ************ *****: $100 in reserve account Vacancy Period from February & March @ $95 per month, total of $190 Per contract a ZERO charge is applied during vacancy period. August Statement shows $29.81 markup. This must be waived because it was never disclosed to me that a markup was going to be charged for every repair. According to Page 3 of 4 of PMA section D2, Property Manager may receive fees/commissions/profits from the affiliated companies not charge an additional fee to the owner. Your fees should be deducted from what was paid to the vendor. There was never any mention of a markup anywhere on the contract. September Statement shows a $693.75 markup which also needs to be refunded $270 plus $90 for pool cleanup (I did not authorize this and contract requires my authorization for all work/repairs over $200) Security Deposit of $3700 to be released to me in full February Rent of $3450 to be released to me in full. No management fee to be charged sunce management agreement was cancelled this month. In reference for 3013 Verdugo: 1. $100 in reserve account 2. Refund property management fee for Vacancy period from September to February that was taken without authorization from my Presidential Funds. 3. $270 plus $55 for pool cleanup (I did not authorize this and contract requires my authorization for all work/repairs over $200) please if I can get help for this issue to be resolved. Ive been struggling so much going back and forth with the head company owner and CEO ****** ***** as they are horrible with accounting and violating my contract I have in place with them.

      To Whom It May Concern,
      My name is ******* ******** and I am the new Broker/CEO for Performance Property
      Management, Inc. Ms. ****** claims are false and inflammatory. We have attempted to explain
      this to her but unfortunately will not listen to reason. We will respond to each of her claims and
      offer proof of her statements and contract. We never kicked her out of our office but have asked
      her to stop harassing us after we provided proof and the information she requested.
      11515 Presidential Dr:
      1) $100 Reserve – The $100 reserve is a sum that is held on hand until the termination of
      management. As you can see from her attached statement, there was never a charge for
      this, it was a rolling ending balance that was used by her final expenses and is accounted
      for.
      2) Property Management Fee During Vacancy – Ms. **** purchased this property on
      1/24/22, our management began 2/7/22, the current tenants applied for the property on
      3/16/22 and the tenants moved in 4/8/22. Our contract states that there will be no
      management fee for an extended period of vacancy. The team who managed the property
      at the time of vacancy is no longer here but I do not consider 60 days an extended period
      of time when you look at the timeline of events.
      3) Maintenance Mark Up – Ms. **** is correct, her contract did not have a maintenance
      mark up written into it so we credited her $723.56 on 2/22/23 to refund her those fees.
      4) Pool Service – Our property management states “Prior approval shall not be required for
      monthly or recurring operating charges or, if in Property Manager's opinion, emergency
      expenditures over the maximum are needed to protect the Property or other property(ies)
      from damage, prevent injury to persons, avoid suspension of necessary services, avoid
      penalties or fines, or suspension of services to tenants required by a lease or rental
      agreement or by law, including, but not limited to, maintaining the Property in a
      condition fit for human habitation as required by Civil Code §§ **** and ****** and
      Health and Safety Code §§ ******* and 17920.10”. The pool and service were included
      in the rental agreement therefore we are required to properly maintain and clean the pool
      so that it can be safely used by the tenant.
      5) Deposit and Rent – Ms. **** was credited for the tenants rent and deposit already.
      According to the tenants ledger (also attached), the tenant made multiple payments in
      January 2023 for February. The tenants deposit was also credited to Ms. **** on 2/7/23.
      6) Management Fee – As you can see from her statement, even though we had ever legal
      right to charge a fee for February 2023 we did not.
