I have video proof and a written statement from this company admitting they damaged my vehicle. From the looks of it, this isnt the first time they have damaged someones vehicle. They are also downplaying the damages and trying to say that they arent as severe as they actually are. I can provide a full list of all the damages. They keep refusing to provide their insurance information as well.Initial Complaint

On may 8/2023 this towing company picked my car up from the dealership and dripped it off at my house the driver carelessly unloaded my vehicle into my home causing mayor damage to my vehicle and home they tried to make me stay quiet and brush this under the carpet I didn’t I got the insurance involved it’s been months now the insurance just gave up and left me with nothing a broken car at the shop and the bills that come with all these damages they gave up on everything is this legal now what the towing company gets away the driver dragged me into my garage I have video surveillance footage all the proof you need and the disrespectful text and phone calls from the insurance telling me to deal with it I need helpBusiness Response

As to the claim from ***** ****** for the issue on 05/08/23 –
The video he provided our company shows he walked up to the tow truck while the
car was still on the trailer and released the e-brake causing it to roll down
the ramp and into his garage and home, although our drivers actions did not
cause the damage we did reach out to Mr. ****** the same day and tried to make
it right. Originally, we were trying to
send a garage door contractor out the same day for the damages and asked what
time works best for him, he didn’t reach back out until after hours in which he
explained he was able to get his garage door shut manually. Mr. ****** texted that a shop would come out
in the morning to look at the garage and the vehicle. Our office manager was texting with him the
following morning trying to get someone out to take care of the damages, he
said he had a shop coming out to give him and estimate for the damages, the
manager asked him to send over the estimates via email which we never
received. The manager asked the driver
if he took pictures of the damages to which he hadn’t so the manager sent him
back out on the 9th to ask the homeowner if he could take pictures
of the damages, there is video Mr. ****** sent to our company showing his wife
and our driver talking as he was asking politely to take pictures. We offered to send someone out to fix the
stucco as well, Mr. ****** insisted he get someone out there and he just bill
us instead, which our manager agreed too but, asked if he would email the
receipts. Mr. ****** sent over a ****** garage
door estimate, ***** ********** estimate and rental car estimate via text with
no actual receipts, he said if that was too much we can just stick to the
insurance policy because he thought there may be hidden fees for the repair of
his vehicle. We told Mr. ****** we could
make the check out to ****** and the ***** Motorsports, we asked who was fixing
the stucco to make that check out and told him we could pay him for the rental
car. Immediately he seemed angry we were
wanting to make the checks out to the contractors and told us to make the
checks out to him or he would lawyer up insisting we were trying to cover things
up and play games with him. Mr. ******
seemed angry in his texts and insisted he shouldn’t have had to do all the work
to arrange for repairs, although we tried to make all the arrangements with our
contractors at his convenience, he didn’t want any of that. At this point our manager talked to the owner
and asked him if he wanted to just let insurance take care of everything since
Mr. ****** seemed to be getting angry to which the owner said yes. On 05/10/23 we contacted our insurance and
gave them the video and explained what happened and they said they would take
care of it. On 05/12/23 Mr. ****** again
texted and asked if we were going to let him handle his own repairs or if he
wanted to go the other way to which the manager replied that we went ahead and submitted
it for the insurance to handle. On
05/15/23 Mr. ****** texted again asking for the insurance number because what
he had was not in service. On 08/10/23
Mr. ****** started texting repeatedly again asking who was going to pay for his
car and claimed all types of other damage to his vehicle via text and also our
insurance company relayed to us he wanted us to pay for a new engine, although
we originally picked it up from *** due to some engine repairs and it was going
to be too much to fix so Mr. ****** was having it towed back to his home. Mr. ****** was upset with the estimate the
insurance company gave him to repair his vehicle of the damages caused from
coming off the trailer the way it did, he refused to accept their estimate and
where they wanted him to take it for repairs.
Mr. ****** then proceeded to text images and his title and said the car
was ours now and he was going to drop it off in our parking lot. We have not had any more contact with Mr.
****** as we turned it over to our insurance to handle on 05/10/23 after his
threats about a lawyer. On 08/16/23 Mr.
****** insurance company reached out to us regarding the incident, this is the
first time he had been in contact with them regarding the incident on 05/08/23
to which we provided the same information to his insurance as we did to
ours. We went into the situation with
Mr. ****** with the intentions of resolving the issues however, he seemed to be
angry with our solutions of paying the contractors directly and wanted
insurance or a lawyer involved so we went ahead with our insurance to help
remedy the situation.Customer Answer

I am rejecting this response because:
My repairs are not completed the appraisal I received from my shop and the appraisal i received from fleet towing inspector was at half the price I was given for the repairs I told inspector I wanted to go with my shop ***** and there estimate was over 4k the appraisal guy for this towing company said no it doesn’t work like that you will have to go off mine the one he wrote out that was $2,000 short of what I was appraised for so I looked around town till I found a shop that will try to work off the half price estimate I received from the insurance inspector I have proof pictures text messages and voice recordings I found a shop near my house that said they could work off his estimate but only if there isn’t any hidden damages there was bent door frame pillar internal parts in the door where crushed my battery completely died due to the door not closing then car wouldn’t start after letting the car sit for week’s waiting on parts then the body shop was contacting me about other repairs found after disassembling the vehicle and he said the inspector inspector kept blowing him off so I came out of pocket bought another door and door handle I got receipts and the shop said they couldn’t keep the car at the shop with out any more payments on the new repairs that where found so I kept going back and forth with adjuster and shop shop asked me to remove the car from his shop due to underpayment from insurance company I towed the car to my house I paid for 4 towings out of my own pocket car wouldn’t start so I told inspector I need a new battery and a registration to my battery I was told they would pay for this i towed it again from my house to the Bakersfield motor works then Bakersfield motor works said I have a massive oil leak that left my car with no oil mind you the tow truck picked it up from *** of Bakersfield my full diagnostics said I needed a sync to my dme and computer the recommended new parts so I declined they checked the entire car and nothing was reported about any oil leaks or engine damage on my reports I had two my car was parked in the same location at *** for 3 days when I helped the tow truck driver load my car up the ground where my car was parked and the tow trucks bed was dry no oil spills but when he delivered my car he was in a hurry to unload the vehicle he asked me to stay on the driver side and release the emergency e brake when he told me to he clearly gave me a thumbs up and yielded out release it so I did because before all this I seen the safety cable installed he took it off when I wasn’t looking i don’t know what he was thinking he had the keys in his van the whole time I even asked him why did you take the cable off he just laughed and said you where supposed to drive it off the ramp I said how you had the keys then he shook his head and said it’s been a long day didn’t even ask me if I was ok or apologized he said it’s ok I’ll send you to my shop I was like no I’m ok I have my own shop then he got mad and said why am I being like this I said sir you almost killed me he replied with but I didn’t my word against yours I said really and pointed at the cameras then he got angry and left then came back demanding we open the garage my wife told him it’s broken he started cursing and saying she was lying I got proof to my car is a mess because this adjuster is trying to penny pinch and force close my claim I need my car fully repaired not 67% like it is I’m being blamed for this drivers actions the oil leak is shown on my video and that driver starring at it wondering where it came from he hooked his hook to the bottom of my engine I’m not asking for an engine just my car to be the way it was or a car replacement since they can’t get it right I’m $1250 out of my own pocket on something I had nothing to do with I paid for you’re wreckless delivery now pay for my full repairs I’ll send all my proof I’m not happy with any of these repairs and they are asking me to pay for another towing to another shop they are leaving me with shop bills they are refusing to pay is this legal
