    An incident occurred on September 12th, 2023, on Lake Merced Blvd. The Professional Tree Care Company had blocked one lane as they trimmed trees. I was driving past in the open lane when they lost control of a large branch that fell on the hood of my car. My car was totaled and the branch only missed me by a couple of feet. While the company's insurance covered most of the cost of my car, the incident had other impacts on my life. I was so thrown by the event that I missed a few days work (I'm an independent consultant billing at $300 an hour so that was lost income). I ended up seeing a therapist for a few months so I could be OK with getting back in a car and leaving the house. ***********************, the president of the company, initially offered to compensate me $7500 for these additional expenses and lost revenue. I countered that I would accept $10,000 but then *********************** backed out of his offer and is no longer in communication with me. After an initial consultation with my attorney I'm of the opinion that punitive damages for negligence (far exceeding $10,000) are appropriate if this moves forward to litigation.

    The BBB outreach to the business was effective.  I have come to an acceptable settlement with the company and I would like to close this complaint.
