    Business Response

    Date: 08/09/2022

Business Response /* (1000, 5, 2022/07/13) */ ***** ****** ********** is renting storage space ****** with our company (Owner). He has signed a rental agreement and is to abide by all rules and policies stated within the agreement. One of the terms of the rental agreement states that "The monthly rent and/or charges, as noted in this Rental Agreement, may be adjusted by Owner effective the month following written notice by Owner to Occupant specifying such adjustment. Such notice shall be given not less than fifteen (15) days prior to the first day on which the adjustment shall be effective." (see SECTION 3 of Rent Agreement). ***** ****** received a notice that the rate to rent his storage unit would increase from ****** to ****** per month, effective July 1st, 2022. This notice of his rent increase was issued on *** ***** ***** Consequently, our rental agreement also states that "Late payment will be subject to the following charges (10 days past due for each period). Occupant agrees to pay Owner the indicated Late Payment Fee if rent is received more than ten (10) days after the due date." ***** ******'s June **** rent payment was received in the form of a check on the 17th of June, and the check was dated on the 11th of June. The check did not cover the late fee ***** ****** had incurred, and per the rent agreement, "Owner, at Owner's sole discretion, may accept or reject partial rent payments." ***** ****** has not made sufficient payments to bring his account balance to zero, and as a result, he received a Preliminary lien notice fee of $20.00 on the 29th of June (for having his account balance be 28 days past due). Several attempts have been made to contact ***** ****** and notify him of the correct charges that were owed, but ***** ****** has not paid the fees that are due. Attached is ***** ******'s signed rent agreement, a copy of his photo ID, his Rental Rate Change Notice form, his completed Occupant Information Sheet, and a copy of his completed Change of Address form with his current home address. Consumer Response /* (3000, 7, 2022/07/21) */ (The consumer indicated he/she DID NOT accept the response from the business.) Carson Storage Venture LP dba Storage Etc Carson did not complete removing the late fee. I have attached the Response with an attachment of the full response and the attachment of this storage facility asking for signature of a new agreement. How come they choose to use the old agreement I signed. They also stated they had no agreement on file. Which was a lie. This is exactly what I stated was the type of discredited behavior that has been practiced at this facility. Right now they are sending price gouging rent increase over the maximum 10%.They havent waived the late fee . Stated they were going to waive. I have also showed the Electronic transfer fund Act violation. They received payment over 17 days and would not show the payment recorded in the online payment account system. They are trying to see me make 2 payments for the same monthly scheduling and then try to deny the refund. when you failed performance and duties when applicable parts of the policy were failed to be adhere to making this section and policy voidable. A Commercial Agreement or Contract may be voidable in the following situations. The terms of the contract were violated. The information and facts were misrepresented or withheld. There are five vitiating factors, misrepresentation, mistake, duress, undue influence, and illegality California Civil Code § 1608 codifies the doctrine of illegality and provides that "if any part of a single consideration for one or more objects, or of several considerations for a single object, is unlawful, the entire contract is void."
