I would like to terminate my agreement with anytime fitness.

I am not comfortable going to the club due to sexual harassment from other club members and
one female employee. I have overheard several of the members and an employee make inappropriate comments about the size of *****. I go to the gym at 4/5am in the morning because I don't want to be bothered by anyone or wait around for equipment. I have tried to keep my distance from everyone and not engage in conversations but they continue to make inappropriate and unwelcomed comments and stares.

The owner can make the tapes available to me and I can identify the members involved and the periods when some of the harassments took place.

Also, it’s always extremely hot in the gym even at 4 or 5am. I literally have to move the floor fans from one equipment to the other in order to stay cool. My body does not tolerate that kind of heat and makes it extremely difficult to work out.

The club also lacks diversity and basic equipment typically found at other gyms.

For all of the reasons noted above I will NOT continue to go to a club I am not satisfied with or pay for the service for the next two year.

    Business Response

    Hello,

I am responding to the ****** ****** Complaint. I have attached Mr. ******'s agreement for review. Mr. ****** originally signed up at another Anytime Fitness in April of 2022 in Palm Desert. He started coming to our gym in Palm Springs because he didnt feel comfortable in Palm Desert?? and my gym was supposedly closer. I asked him why he didnt like Palm Desert and he didnt answer me he just said he liked our gym better. It is suspicious that another member would leave their home gym and transfer to a different gym. Mr ****** called the gym a couple weeks ago and said he wanted to cancel his agreement. I told him he would have to pay a buyout and he was upset. I said I would check into his agreement to see if there was a different buyout clause and there was not. He is obligated to the agreement. So, he called me again and stated that he called the billing company and they said that he would need to talk with the gym to cancel. So, he called me again and I stated that he was still obligated. He then said that he was being harrassed at the gym and he was uncomfortable being there and the equipment was not right for him. I said he should go back to his original gym then and he stated he wanted to cancel. We hung up and I then reveiwed the cameras when Mr ****** was working out and there were only 3 -5 other people in the gym during the early morning times he was there and no one was close to him and no one talked to him? He called me back a couple days later insisting to cancel and he would not negotiate a discounted buyout. I told him I reveiwed the cameras and he was not close to anyone and no one was harassing him . I told him he can go back to Palm Desert gym if he wants otherwise he is bound by contract. He did not like this and then hung up on me. I see now he called the BBB to complain but I have been nothing but attentive to his calls and legally professional with him and his agreement. Not sure what else to do????
