    This a predatory loans with a predatory interest rate. Over 700% interest rate. Please settle my account for the amount already paid which is more than what was borrowed. Please settle my account to paid in full with amount paid. Please settle as paid in full with to affect on my credit or credit report.

    I am rejecting this response because: the solution is not agreeable.   The amount borrowed has been far exceeded.   Please mark account paid in full.

    The Payoff amount of $831.55 previously proposed to the Complainant was, in our opinion, a very reasonable settlement offer, without incurring a prepayment penalty, and representing a significant cost savings $778.24 (Current Contractual Amount $1,609.79 Proposed Payoff Amount $831.55).

    Unfortunately, as the Complainant has stated, the offer has been rejected and not an agreeable solution. As of October 14, 2024, the Complainant has not made a payment since September 27, 2024. Therefore, as a result, the Payoff proposal has been rescinded and the original agreed upon repayment terms will continue until the outstanding balance is paid-in-full.

    I was hurting for money and was going to take out a small loan. Due to the price of the loan, I canceled. They told me the already sent the funds so, they withdrew it. That is was all set. I thanked them and moved on. Two days later I am told that I still owe the money! I never gave this company my bank account information. Only my debit card. Turns out THEY, as in Amicus lending, picked a bank out of a hat, A VER Y OLD CHECKING ACCOUNT that I had YEARS AGO, and sent the money a a closed account. I contacted TRADEWINDS ************* The money was not accepted into their institution because the account is closed and has been closed for many years. They told me that because the account is closed, any ***** trying to be debited to the account would of course, go back to sender. This is not my fault. The information I gave them personally is not the information they decided to use to give me a super expensive loan. Upon speaking with someone at Amicus. He confirmed that the debit card I gave them was correct and THEY LOOKED UP A BANK ACCOUNT to ach the payment. They did not use information given to them by myself. This money was not only sent back to them by a reputable banking institution (TRADEWINDS ************** they without my permission, deposited into an account unconfirmed by myself as a dirty tactic to FORCE an expensive loan. I never received 500 dollars from this company. This is not money I should be responsible for.

    Borrower (Applicant) applied for a loan on Sunday, February 11, 2024 by completing an on-line application. As a lending requirement, the Borrower provides, to include but not limited to,their Personal Contact Information, Employment Information, and Banking Information. The Banking information serves two purposes: (1) to designate their preferred funding method, which is a Checking Account or Debit Card, both of which must be associated with the same Financial Institution, and (2)scheduled payments will be made from either payment method on file.

    The Debit Card provided was associated with a different Financial Institution ****************** than the Bank Account provided (Community ******************* Therefore, in order to advance the loan funds in the amount of $500.00 to the Borrower in a timely manner, we submitted the funds to the default payment method, which was the Checking Account. Borrower provided their signature authorizing Amicus Lending to deposit loan funds to Community ***************** with the Routing and Checking Account Number referenced in the On-Line Loan Application and Loan Agreement.

    Subsequent to the funds being submitted to the Financial Institution on Monday, February 12, 2024, ******** requested to cancel the loan. When the loan funds were submitted to the Financial Institution the a response code was returned indicating that the Checking Account had been closed, and retained the funds. As of this writing, the Financial Institution has still not returned the $500.00. Prior to a merger with Community ***************** in 2018, the Checking Account was once associated with ************************ Until this issue is resolved the repayment of the loan funds remains the responsibility of the Borrower, as outlined in the Loan Agreement signed on Sunday, February 11, 2024.

    In an attempt to resolve this account issue, numerous email correspondence occurred between Borrower and Amicus Lending. And, with each email, we have been able understand what had transpired and reach an agreeable solution. To this end, Borrower emailed Amicus Lending on Tuesday, February 20, 2024 and Monday, February 26, 2024 acknowledging that Community ***************** received the funds into the Checking Account and that the funds were retained because of outstanding unpaid fees related to the account that were offset by the loan funds of $500.00. Borrower has indicated that the $500.00 will be repaid in full by March 28, 2024. However, the loan payoff amount must include accrued interest and late fees through March 28, 2024 or the date of the payoff amount. Borrower also has the option of repaying the loan in accordance with the repayment terms outlined in the Truth-In-Lending Act Disclosure and Loan Agreement.
