Air Tech Environmental came following a water damage incident in my home caused by a burst pipe under my shower head. Xact Restoration, called in Air Tech Environmental. Initially, I didnt contact Air Tech directly; they seemed to have coordinated with the insurance company after being called in by Xact Restoration. The complication arose after the completion of asbestos demolition in my home. Observing some black stains at the base of the wall, I grew concerned about potential mold and reached out to Xact Restoration. They assured me a technician would visit to inspect the issue without any charge. True to their word, Air Tech technicians arrived the next day. My brother, the homeowner, who has been recovering from a stroke for the past two years, met them. Unaware of their separate company identity, he signed a document they presented, unknowingly authorizing Air Tech to perform further work. Air Tech's subsequent actions have been a source of significant frustration. They conducted asbestos sampling in the walls, a service that seemed redundant since we already knew the walls contained asbestos from previous tests. However, Air Tech proceeded without providing any cost estimate, likely under the assumption that the insurance would cover it. Meanwhile, Forte Environmental, another asbestos remediation company, sent an estimate for demolishing the walls in the affected area, which I declined, knowing that insurance would no longer cover these services. The main issue I have with Air Tech is their insistence on charging us for these unsolicited services. They billed us around $1250, including a $700 visit fee, for the asbestos sampling and tests services that we neither directly requested nor were informed about in terms of costs. *** tried explaining this situation to Air Tech representatives multiple times, but they continue to assert their right to charge for these unrequested services.Business Response

Air-Tech Environmental, Inc. is an environmental testing company that tests for asbestos, lead, mold etc. We were informed, in June, by ************************, the homeowner, restoration company (Xact Restoration), on his behalf, that he was in need of limited asbestos and lead testing. The point of contact provided was his brother *****************************. Our project coordinator called ****** to get authorization for the testing that was being requested and to schedule a date to go to his brothers property to perform the service. ****** authorized the testing and an appointment was scheduled for 6/19/23. ****** had informed us that his brother, ******* (homeowner), would be onsite to sign our service agreement. We showed up at the scheduled appointment time and ******* signed our service agreement, allowed ************** to go onto the property and we performed the testing services as requested in certain areas of the home.We billed ************************** as directed by the signed service agreement. We received prompt payment from ************************** for the initial testing.
Since the testing results from 6/19/23 had come back positive for asbestos the homeowner needed to have an abatement company remove the asbestos materials. Once the abatement was completed in August, we were requested by the abatement company (Forte Environmental), on behalf of *******, that he was in need of additional services: an asbestos clearance to confirm there were no asbestos fibers remaining in the areas that were abated. ********* project coordinator,clearly stating who she was and what company she worked with, contacted ****** to let him know what the abatement company had requested and to schedule a second appointment for 8/30/23. He again authorized the service and informed us that his brother, *******, would be onsite to sign our service agreement and give access to ********* technician. Once onsite, ******* gave access to ********* technician to perform the testing and signed our service agreement. Xact Restorations technician was also onsite on 8/30/23 and informed us that the kitchen was also an affected area that was not tested initially in June and needed to be tested. ******* was present during this interaction and we proceeded to pull samples for asbestos from the kitchen as requested with ******** approval (as per the signed service agreement).
Unfortunately, ***************** does not cover clearance testing and therefore we collected payment onsite from ******* for the clearance and we billed his insurance for the additional testing that was completed. We had been informed by ******** insurance company that he had reached his policy limits and they were not able to cover the additional testing. We then contacted ****** for payment for the additional testing, letting him know the policy limits were met and ******** insurance would not be able to cover. Per the signed service agreement, that makes ********************* for payment.
Our base prices can be found on our service agreements,including the agreement that was signed by ******* in June and additionally the second one in August. This could have been read at any time by ******* or *************We have contacted ****** multiple times explaining that he himself set up the second appointment with us directly and authorized the second visit to the home. We also explained that he, himself, informed us that his brother,*******, would be onsite the second visit to sign our service agreement. We were open and honest about what company we work for and what services were being provided. Our technicians also wear company shirts with our logo and company name, as well as drive a company car with the company logo. Once we found out the second service was not going to be covered by the insurance company, we offered ****** a discount on our invoice to help with the out of pocket costs, but he never addressed it in any of his responses.

I am writing to file a formal complaint against Air Tech Environmental *** regarding their unfair billing practices and lack of transparency in providing pricing information for their services.On 09/21/23, I was contacted by Air Tech Environmental *** to inquire about asbestos and lead testing for my property. I was provided with an agreement that stated a Limited Asbestos Survey at $39 per sample, a Limited Survey of Lead-Based Paint at $39 per sample, and a site visit fee of $781. Additionally, the agreement included a cancellation fee of $495 if the project was canceled, with the specific verbiage stating, "in the event that the client decides to cancel the project, Air-Tech will charge $495 for the site visit; this amount will be billed to the insurance or client directly."To my surprise, I received an invoice for $2240. I immediately contacted the accounting manager to express my concerns about the sudden increase in pricing and the lack of a breakdown before the testing began and the lack of showing me the findings/reports/pricing. After my discussion with the accounting manager, the invoice was lowered to $1800, but Air Tech Environmental *** is now attempting to place a lien on my house for the original amount of $2240.It is crucial to note that I never formally placed an order for the testing services, and Air Tech sent a technician to my property even before the agreement was signed. Additionally, my insurance was not going to cover the entire cost of the claim, leading me to withdraw the claim and subsequently cancel the project. In good faith, I offered to pay $1152, which covers the site visit and testing services that were provided. Unfortunately, my offer was disregarded by the company.I am writing this complaint with the expectation of a fair resolution. I request that a new invoice be issued for the agreed-upon amount of $1152, which I am willing to pay promptly.Business Response

Air-Tech Environmental, Inc. is an environmental testing company that tests for asbestos, lead, mold etc. We were informed by Ms. ******** restoration company, on her behalf, that she was in need of asbestos and lead testing. Our project coordinator called ****************** to get authorization for the testing that was being requested and to schedule a date to go to her property to perform the service. ****************** authorized the testing and an appointment was scheduled. As stated in the complaint, ****************** was provided with a service agreement (contract) on 09/21/23 listing our base prices. She signed the agreement via Adobe Acrobat Sign. We arrived at Ms. ******** property on 9/21/23 at the scheduled appointment and were granted access to complete the requested services. The collected samples were sent to a 3rd party lab to be analyzed. The results were received from the laboratory and sent to Mercury and Ms. ******** restoration company. As directed on the service agreement, by ******************, we sent the invoice to Mercury for consideration of coverage.
As we explained to ****************** via email, which was not attached to this complaint, we did not receive any cancellation requests from her via phone, email, nor to the technician prior to the service provided or while we were on site. ****************** had advised us on 9/27 that she withdrew her claim with ***************** that day, which was 6 days after our services were completed on 09/21/23. Withdrawing her claim with ***************** does not absolve the services completed on her property. By 9/27 we had already incurred multiple business expenses due to providing the service to ******************. We have to pay for the 3rd party lab to analyze the samples on top of overhead costs for labor and travel costs. One is not able to cancel services after they have already been provided. Furthermore, we explained that we were not able to provide an exact invoice amount prior to the services being completed on her property as the price directly coincides with the number of samples analyzed at the laboratory. This means that we would not have had an exact price until we received results from the laboratory detailing what kind of materials were found on her property. We did provide ****************** with the invoice showing the breakdown of the services provided. These services adhere to the terms of the service agreement she signed with us. In order to assist with her financial situation, we lowered our invoice to $1833 from the original $2240, which includes the site visit and the samples analyzed for asbestos and lead. We agreed to accept the site visit and the price for the testing services, which is where the amount of $1833 was derived from. It is stated in Ms. ******** complaint that she is willing to pay for the site visit, which is $780, the testing samples for asbestos, which is $702, and the testing samples for lead,which is $351. Ms. ******** proposed calculation of $1152 does not cover the above-listed services.

I called for a quote on testing the downstairs for asbestos. I was given the Quote $365 to take the samples and $30 or $25 per asbestos test, at that time I asked why the difference in price and the phone rep said the $30 was for expedited .. I joked on why anyone would quibble over $5 after paying the large price of a visit, as $5 was such a small number. It is now clear that charging per sample the $5 adds up and I wouldn’t have taken the expedited. the nice lady should have told me that a test was per sample and many samples would be taken, this did not happen.
At no time was the testing explained to be a cost per sample nor that 3 samples are required to test. Although 3 samples may be required by policy and law, there is no requirement that the homeowner would know that the $30 was per sample. In fact if logic states that something can only be purchased in a set the total cost would be for the set, I would have not chosen the expedited nor the testing of my own upstairs unit had I been told this information.
It was only mentioned at the end of the call lead testing would also be required and I agreed to it the same at $40
My expectation at the time of the visit was $365 for the visit $30x2 for asbestos both units and $40x2 for lead both units. ($505 total)
During the visit I realized that the area to be tested was a corner and 2 walls would need tested. I asked if each wall would cost separate and was told yes, now my expectation was expecting the $70 ($30 asbestos + $40 lead ) to have 1 or 2 more rounds depending if two or three walls were tested. This upped the expectation from $505 to $575 or $645 if three walls were tested.
Much to my surprise $779 was debited from my card.
Although if I had known from the start I would have not have had expedited timeframe nor the second site (unit218) tested , they should be paid for what was quoted and the unavoidable truth that "per sample" is unknowable to someone not in the industry unless toldBusiness Response
