    A partial payment of $3,000 was given to the business owner for upfront money for supplies and labor on an artificial turf install job. Prior to engaging his business, it was emphasized that the job had to be completed no later than October 11, 2023. He indicated that the job would be completed on time. Based on that, I engaged him. He was to begin working on the job the following morning (Friday, October 6, 2023). ***** and one man showed up on Friday at approximately 10 AM. Work on Friday was limited to grass removal only--no leveling, caping of sprinklers, etc. He then indicated that he would be going out of town for his daughters soccer tournament. I assumed it was to be for the week-end, but his workers would show up the following morning, Saturday, and continue to work. No one showed up. Monday morningno one shows up. I called *****. He indicated that he was going to be out of town the entire week and that his worker was not feeling good! He assured me that they would show up Tuesday. Tuesday comes, no one shows up. He then claims that I never told him that I needed the job completed by October 11. At this point I told him I no longer wanted his services and to please refund all but $500 for his labor on Friday (he states his labor cost for the day was $250 plus supplies). He then states that I indicated that there was no time frame for completion and that I was not *********** any refund. He further stated that I was not owed anything back as he had already purchased the turf and supplies. I followed up with a phone call to the turf business, and they indicated that nothing had been purchasedwhich ***** later acknowledged. He later agreed to refund $1,500 which was not considered reasonable, and not accepted--I countered.] This is a condensed synopsis. Additional information is available, including photos; however, the aforementioned, outlines what has basically transpired. As of the date of this letter, $1 has been refunded.

    I have been in contact with **** ******** sine June about synthetic turf at her house. I even wrote up a bid for her neighbor. I rewrote the bid multiple times and brought her synthetic grass samples on at least 3 occasions. She was finally ready to do the job we made an agreement I removed all the dirt, adjusted her sprinkler system, and was ready to return next week but hadn't given her a day yet. All the sudden she says it has to be done by Thursday. I had mentioned I was at a town all week for my daughter's soccer playoffs. But I would be back one day during the help. But didn't know the schedule yet period I tried to get someone out there on Tuesday but he was still sick and she immediately demanded refund of $2500 of a $3000 deposit for labor and material on a $3900 job. The job was half completed. I told her that I had already paid more in dirt disposal fee, What I paid my laborer, and equipment rental that day. And she can't expect me to walk away. Taking a loss or making no money on a job That was halfway complete, and she had no legitimate reason to fire me. And she prevented us from completing the job which could have been completed by Wednesday. I had to call the police to ****** my workers to pick up my equipment Because she refused to return it. I offered her $1500 refund which she agreed to. Then the next morning when I was gonna wire her the money and my workers were gonna pick up my equipment, she said that it was ****, Refused to return my equipment. That's when I had to call the police because she was supposed to go out of town for 3 weeks And I cannot have my equipment locked away. She has threatened to *** me and I am definitely going to counter *** or *** her if she doesn't end up suing me. I will be suing her for breach of contract and all, slander, and The unnecessary expense and inconvenience this has caused me. I am very upset that she would go as far as to slander my bbb Business page. I did everything possible to try to mediate with this lady. Even offering to finish the job even though I was uncomfortable That she would not pay me once we were done. she mentioned that someone who gave her a bid in the past got back ahold of her and she wanted to consult with him, but after doing so much leg work on the job I negotiated price with her lowered it and she agreed to stick to her word from day 1 she promised to use me for the job. I know that she got a price from him and tried to s**** me to use him to save money Which is very crooked of a person to do Especially when I have put in days Of work already into this job, before the labor portion even started. And to have the job halfway complete, Take a loss just for somebody to come in and use my weed mat which she stole and easily complete a job at a discounted price is something i cannot stomach. Never would i personally treat someone this terribly with disregard for their personal life, property, livelihood, business, and family. She kept my inventory industrial strength 15ft wide weed mat role which i need for other jobs even tho i offered to leave her with the amount she needed to have someone else complete the job. I ask that this report not be posted to my business page. I feel confident that this will be corrected in court. I have all the evidence that I need. *************** with lawyers and it will be handled accordingly. I plan on writing more thorough contracts in the future.  So there is less room for question. Thank you

     I am rejecting this response because:

    He continues to embellish, threaten and lie.  I will proceed to file a lawsuit with Small Claims. 

    I was hoping to avoid a lawsuit, but I have no choice but to continue.  I don't see BBB resolving this issue.
