      On 6/12/23 I was purposely misled into purchasing items at ************************* and was told it is acceptable and risk free to conservatively overbuy hardware items for my project because they could be returned in new and unused condition within 30 days. 7 days later 100% new and unused items were requested as returns and the establishment would not return them and stated no reason given. They did not state the items were open and used because they are still in the packaging. I would simply like to return all of the items on this receipt. All items are 100% new and unused as the project was not started.When the establishment is called at ************, the associates state the return policy is 30 days for new and unused items.

      All returns are subject to review by the manager of the store location. Our return policy is displayed upon entry to our establishment. In this case the items and terms were reviewed, and the manager has decided not to accept the return.

       I am rejecting this response because: I was told without question by the associate that there would be no issues returning any of the merchandise if it was in new and unused condition within 30 days. I returned to the store less than 2 weeks later with new and unused tools (please see photographs). The items were never used and the establishment has yet to provide a  reason for not accepting the return based on the associate's clear response regarding the return policy. There is still yet to be any reason provided by the establishment as to why the associates clearly misled me and sold me numerous expensive tools under the assumption that they could be returned. They suggested that I buy multiple types of the same bolt cutters (see photos) for my project solely due to the fact that they could be returned. I agreed that this was a very reasonable approach not knowing that the establishment would then reject any returns. This is completely unethical and misleading. I still have all of the new tools. Please see photographs for some of the expensive items.

      I will close the case if the establishment will provide a valid reason for stating new and unused tools could be returned within 30 days and then completely reversing course. Profitability of the store is not valid. I still have the items and if agreed upon I will return them to the store and also close the case. Again, the items in the attached photos are completely re-saleable and are still adhered to factory packaging.

      It is evident that since no reason is being provided for the rejected return of new and unused items within 30 days that the store is simply trying to deceive customers of small construction businesses into overbuying tools with no possibility of return. There is also a possibility that the store rejected the return due to discrimination. A female employee attempted the return and was treated very poorly and in a very sexist, demeaning and degrading fashion in an obviously male dominated store. This is a matter that will be pursed outside of this matter but will also be considered resolved if this matter is resolved.
