My daughter, ***********************************, was charged for "$50 application fee" to reserve and obtain the cost of a 3 bedroom apartment which their website said was available, with a move in date of September **** (I have screen shots of the web page). Her roommate filled out the same application three days prior with my daughters name on it as a tenant and never received a call. My daughter completed her own application today (12/28/2023) which initially was free after inputting all your personal information and then states you need to pay $50 to receive the cost of the apartment. She received a call the same day saying there were no three bedrooms available. They tried to upsell her into a 4 bedroom apartment at a rate of $1700 per tenant. When my daughter asked if they could refund the application fee since no 3 bedroom apartments were available, they refused

My daughter, *******************, signed a contract with Identity Davis for one year, was charged for "$50 application fee" and "$100 redecoration fee" on top of the rentals when she moved in.One year later, when she moved out of the apartment, a move-out inspection was arranged and despite that the inspection passed without any complaint, we were again charged for "$200 cleaning and painting fee", we contacted the manager, *********************************, regarding the details about these 2 charges, ******** confirmed we did pass the inspection, told us that these were for touch-up and filter changes, when were asked about the itemized fixes Identity did, ******** sent us several pictures(pictures attached). I pointed out, first of all, these tears and wears are not tenant's responsibility, and secondly, even if it is our responsibility, why do we have to pay twice when moving in AND out? why Identity failed to mention the standard charge in the contract like the redecoration and application fee? (******** told us that the "moving out cleaning and painting fee" is standard and based on the size of the room) After that, Identity stopped responses, and we paid the full amount before filing this complaint. We would like to have "$100 redecoration fee" and "$200 cleaning and painting fee" refunded.
