Date of wedding event: February 9, 2024 Deposit: $250 Full payment: $896.50 Business committed to serving my wedding guests. He had bad communication after I gave him the initial deposit. When he arrived late at my wedding, I told them not to serve and to just leave. They left and I got daily constant messages demanding payment, even though the payment due date was on March 10. He threatened my elderly parents by finding their address and sending it to me. After that, I felt I needed to protect my family and so I paid him. Even after I completed the payment, without him completing his services, he keeps harassing me, and it is already March 11, 2024. Completely unprofessional. I never once said I would not pay. I even went as far as saying I will pay by the due date but he did not like that and kept messaging me. I will include all the texts he sent me as evidence.

    Business Response

This is my response to complaint #********

My name is *********************** owner of El Churrero catering in *********. ******************************* reached out to our submission form on our website asking for our churro catering service for his wedding date of February 9th, 2024. We responded with our menu and pricing sheet.  He wanted to proceed with our churro services for 100 guests between the hours of 7pm-9pm at *********************. We sent him an itemized invoice with all the information which he paid the date deposit. At this point both parties agreed that El Churrero services start at 7pm and end at 9pm.  ******* winery has a steep dirt service road for all vendors. El Churrero staff got stuck at the bottom of the road due to extreme rain. At this time, El Churrero staff called me *********************** to tell me. At this time, I called the wedding coordinator ************************* and property manager ***********************. *** said she was on top of the problem and had someone from the winery to go help my staff get up the hill. My staff arrived at the location to unload and set up in time to serve at 7pm. The attached image has a time stamp of 7pm with churros ready. In addition, my staff has served churros to wedding guests before ******* assistant was told by ******** wife to have El Churrero leave with no explanation. After ******, *** and the wedding coordinators assistant tried to tell the bride that churros are ready, and guests are enjoying she demanded El Churrero leave. My staff called and I said if thats what they want we need to leave. That night I spoke with ****** and *** multiple times, and they had no idea why ******** wife told El Churrero to leave. I reached out to *******, and he never responded. After 5 days he finally responded with no explanation. I asked him to pay the balance and he said he would base on the date that PayPal provides and not what it states in the itemized invoice. PayPal sets there date so if the balance is not paid in that time their system will send reminders. I felt like ******* was not going to pay the invoice so I sent him his address to confirm so my lawyer can provide documentation for small claims court. You will see there was no threat. If necessary, I will provide *********************** and *************************** information based on request. They have been notified and both agreed to make a statement about February 9th event. At no point was there any discussion about changing the starting time or El Churrero being late. In addition, *******, his wife and friends have bashed our business on Yelp and social media. They have opened fake accounts to repeat the false allocations. Yelp has removed some of the reviews based on false allocations.

    Customer Answer

    Date: 05/15/2024

I have come to terms that there will be no resolution with this since I have already paid and honored the original agreement. Before I drop this matter for good, I want to point out some lies about ******* explanation.

    1. "After 5 days he finally responded with no explanation."

This is a lie. Per my original screenshots, ***** and I exchanged text messages on Feb 10, Feb 11, Feb 14. I was married on Feb 9, so his claim of me not responding for 5 days is ridiculous. I also clearly stated that I would pay him before the invoice due date, which I did

    2. "I sent him his address to confirm so my lawyer can provide documentation for small claims court."

The address he sent is that of my elderly parents, and not my address. I am not sure how he came to acquire this information, as I did not disclose this at any point in our conversations prior to our agreement. When I asked why he sent that, he offered no explanation for an entire day. When I let him know that I take threats to my family very seriously, then and only then was when he responded with "There was no threat big guy. I needed confirmation of address for my lawyer". I let him know that I did not live there, and he never asked for an address again. He must have never been in contact with a lawyer since he never asked me for my address again. If he really did needed my address for his lawyer, he would have asked me.

    3. "At no point was there any discussion about changing the starting time"

Another lie. I have a text message thread between me and my wedding coordinator confirming that *** had talked to ***** and confirmed 6:30pm to 8:30pm on Thursday Feb 8.

Anywho. I hope everyone has a good day.
