    Purchased a damaged engine assembly with the sole purpose of being able to use the engine block as a source to rebuild and install for a service customer. During every contact with American Dismantling employee named **** from initial phone call to picking up the engine assembly the goal of using the engine for this purpose was made clear. During the pick up process I stated to cruise that I didn't care if the engine was ugly as long as the engine block was good. His response was "the block is good". Turns out the block was not usable due to unseen damage that could not be detected until the unit was disassembled. When I called to inform **** his response was unit is sold as is and they would not do anything to correct the situation unless I wanted to buy another engine from them. I am seeking either a refund of my purchase price of $2000 or a replacement unit that i can use with the $2000 going towards this purchase.

    I have attached a copy of the customer's invoice for your records. The customer was advised of the fire damage to the vehicle and that the engine assembly would have to be sold as is without a warranty due to this fact. You can clearly see the invoice was stamped "No Warranty Sold As Is" and the customer signature acknowledging that fact. We regret that the customer is unsatisfied with their purchase, however we offered a fantastic price for this engine in exchange for the customer accepting the risk that this engine may not be salvageable, and allowed the customer to visually inspect the engine before taking the part. American Dismantling stands by the decision not to accept the return of this engine

    The customer was well aware that this engine suffered fire damage and would be sold as is with no warranty. The stamp was not added after the customer took delivery of the engine. You can clearly see the word "FIRE" printed in the item/description section of the invoice. Please refer to the original photo I uploaded in regards to this complaint.

    I purchased a transmission from them for $1000 and they delivered it to my shop where my best mechanic installed it on the customers car. It was an urgent situation to begin with as the customer needed their vehicle fixed in a timely manner. Needless to say, they were very upset when the transmission stopped working hours after we gave him his car. The car was towed back to us the same day and we had to search and purchase a whole other transmission from a different company, which we paid another almost $1000, and this one worked perfectly. We personally drove to their yard 90 miles away to return the transmission and get a refund as their website claims. Upon arrival I was rudely made to wait for almost an hour with no communication as to what is happening while they took the transmission out of sight. I was literally standing in front of 4 workers waiting while all of them just ignored me nor spoke to me or advised me what's going on. One person emerged finally saying that we would not be getting a refund because we had "opened the valve body" and took it apart. He also claimed to have found "bolts in the oil pan" but did not show me any bolts. They refused to help in any way, they said those two sentences and proceeded to ignore me again. I have the entire repair on video on my security cameras, we never opened the valve body or anything of the sort. We would never do that. They lied and they do this often based on their reviews online. I lost $1000 on buying a second transmission which I have the receipt for. I lost several hours of my time & my mechanics time who accompanied me to their JUNK yard (gas also) I lost that customer probably forever. I lost out on other jobs that I had scheduled that week because suddenly I had this emergency that needed to be resolved. I lost money on the job itself because I had to pay for a tow truck and causing the customer major issues at an important time for him made me not charge him labor for this repair

    I have attached photos and videos for your review. We mark all of the parts that we sell with hidden indicators that tell us if a part has been tampered with after sale. After reviewing the evidence for myself along with testimony from my part inspector, it is clear that the transmission was opened at some point after being sold. Unfortunately this voids the warranty as indicated in the first sentence of the last paragraph of our warranty policy at the bottom of the original purchase invoice which states "We will not accept returned parts if they have been painted or tampered with." I apologize for the inconvenience this issue has caused, however American Dismantling, Inc. is inclined to uphold its original decision to not accept the part for a refund at this time.

     I am rejecting this response because:


    Upon  Installation of any used transmission it is required to change the fluid and change the filter. There is a difference between servicing a transmission and tampering with it. We did not tamper with this transmission. We were sold a bad transmission from the beginning.

      Instead of accepting the fact that their used transmission was falsely advertised as operational, they refused to return my money.   This company is attempting to escape having to refund me by saying that it is our fault the transmission does not work? That cannot be possible and any third party that looks at this should be able to see that.  This transmission was purchased based on the listing advertised by this company stating that it "runs good" in addition to the phone rep confirming it "runs good" and that if we had any problems there is a warranty on it.  This is a common practice of this company judging by the multiple reviews on yelp and Google stating the same thing 

    After we installed it and it did not work, we took it back to them the next day and they took it somewhere where I could not see what they were doing and came out later denying my refund of $1000 because "it is our fault it doesn't work.?" This is predatory and almost cost me my entire business.  I am a new company trying to make it and this not only cost me my potential profit on that job, but it also cost me an extra $1000 to purchase a second transmission from someone else (which i borrowed with interest), 2 full days labor to my mechanic to remove and install another transmission, a full days work for my office personnel to search and locate the second transmission and drive 90 miles to return this transmission (only to be denied) plus the gas involved, I lost out on the jobs I had scheduled for this 2 days which I had to cancel, and I lost this customer forever.

    The photos provided by American Dismantling  have ALL of the exif data deleted from them.  If these are truly the photos of the transmission in question from the exact day I took it back to them for refund, then why delete all the details from the photos?  In fact, these photos are not of the same transmission.  You cannot even see the serial numbers in their photos.  

    My shop has a state of the art security system.  The footage of this transmission being installed from the moment it was delivered to my shop throughout the full installation and removal is on video.  You can clearly see we did not tamper with it or open the valve body.  I can provide that if required or I can provide it to the judge after I file a small claims case for the full amount of my losses.  My hope was to avoid having to do that but as detailed above my losses are too much and their outright lying and denying a rightful refund to a fellow business who's trying their best to survive is disappointing and should not be allowed.
