    First choice trucking school wasn’t committed to helping me obtain my class A license.
    My nature of disputed is to be a refunded.
    I’m the only American Indian in class. And he’s kicked me out the week I was supposed to take my test at the dmv. I get 3 tries to use his truck. He told me he’s done purposely and I get no refund.
    He’s been hard on me since the first day. I noticed he wasn’t as hands on with me with the other students and I ask him is my money not the same as everyone else? He had a grudge on me every since. I had two more sessions coming up on 2-3-23 and 2-9-23 before he cancelled and gave up on me.

    Mr. ***** **** enrolled on 12-07-22, Contrary to is complaint, He did not pay $4500 in one full payment. He payed discounted price of $4000 in two payments. He read and signed both invoice receipt and service agreement (which we will provide a copy off  as proof )  where it clearly reads in bold letters.

    “After 30 calender day’s or after completing 5th training session there are NO REFUNDS”

    Also incorrect is the number of DMV appointments. He claims he was promised 3 but clearly reads 30 to 60 hours & 2 DMV appointments on receipt.  Mr. **** made $2000 first payment on 12-07-22 . He then began training on 12-08-22. He completed his first five hands-on-training sessions between dates 12-08-22 & 12-20-22. 

    On 12-19-22 he made his second & final payment of $2000. If he was unsatisfied in services rendered to him, he did not have to make 2nd payment and continue training.  Mr. **** continued training inside our concrete yard, using our commercial equipment, he took a seat in all our defensive driving classroom time, participated in open range time and that’s including all the different recovery parking skill we cover.

     In the 2 Month’s he attended total hours exceeded over 60 hours of service’s. Services were rendered between 12-08-22 & 2-07-23. Mr. **** poor conduct made myself and other trainees uncomfortable from first week of training, Before making his second payment I politely advised him that if is not happy with services he did not have to make second payment or continue training. There are many other larger training facilities near bye. Mr. **** understood, he insisted on making his 2nd payment on his own accord and decided to continue using our equipment and continue training at our small but effective training facility.

    On 1/26/23 he became aggressively irritable (more than usual) with myself and other Instructors. When all we were trying to do is help him get a good understating on safe procedures. I politely asked him to walk with me inside office so that we could discuss if this is right program for him. This was the second discussion regarding is conduct. Once inside office he became increasingly aggressive and began to yell at me in front of office rep inside our office. He yelled loudly  “Why am I the only one asked to come inside office with you! Why?”  “Why don’t you ask everyone else” “Why?” I tried to explain but I couldn’t get in a word in over his yelling. At this point I was feeling very stressed and unsafe with his behavior. In fact  I offered Mr. **** a full refund and he refused to accept. Instead Mr. **** started raising his voice in a loud screech sound and crying stating “I don’t want a Refund, I want to continue here at first choice trucking”. Mr. **** suddenly calmed down enough to try and apologize. I remember him mumble-ling under his breath “ I don’t know why I act like this” he than began to promise that he would conduct himself in a respectful and proper manner and follow instructions. For the better part of one hour, he spend inside our office trying to calm down. All awhile keeping us from continuing with our daily work schedule. We had to stop in the middle of the day to try to console Mr. **** for we did not think it was safe for him to leave in that condition. After one roll of tissue and one hour passed he then managed to calm down and announces that he doesn’t want to go to a different training facility and would like to continue with our training program. I reluctantly accepted his apology and advise him that moving forward this could not happen again and if it did there would be no further refunds possible. He agreed and signed a quick agreement I wrote on paper. (Which I will also provide a copy of) Mr.**** eventually calmed down enough to leave.  Mr **** send me a written apology for his behavior via text. (Which I will also be providing) In Mr. **** hearth felt apology message he stated  “ You are a great Instructor and thank you for pulling for me” he also goes on to say “I wish I kept my mouth shut”, “ it wont happen again”

    What M******* is saying is all false. I’m not sure where to start but once again. Once I stated to him he hasn’t been as hands on with me as the other students. He only let me attend class twice out of the week. Mostly  because bad weather conditions. As I found out he was still letting the  other students go in these so bad weather conditions I found out. Out of the two days I was there Mr. ******** would pull me aside of class rush my courses i do with him and tell me he’s going to test drive me at the end of the day. When everyone else is gone!. He start Down talking me, talking about my son, and saying I should change careers. Trucking might not be for me. His exact words. I was being simple minded and was trying not to quit. I have my test on Friday. Just have to get through two days with him.  When Thursday came the day before my test. He’s sees I’m excited and can’t wait to go. He tell me when I’m alone again I can go take my test but not use his truck as well  can’t get no refund. He only drove with me for 5 minutes before saying it. He already had it planned from the beginning he didn’t want to deal with my kind as well he Canceled on me. As well stated he don’t like teaching native Americans.  He said you get 30 calendar 
    Days and  from December 23  through January 9. The school was close for Holliday’s and new years.. He went  out of town as the other instructors. With all the dates he have,  I was only in his class for 14 days not even a full 30 calendar days with the 2 days out of the week he allowed me to go because of the rain.
