      AAA failed to provide a competent arbitrator. AAA failed to provide accurate and timely information. AAA failed to provide a copy of the arbitration proceedings when requested.

      1) Stephen Porter ignored rules, precedent and facts in evidence in his judgement resulting in significant damages. He also failed to change the award to reflect our factual corrections that were submitted in a timely fashion.

      2) Jade ********* failed to respond to request for clarification of rules regarding corrections and appeals.

      3) Jade ********* failed to respond to request for an accounting of refunds given to all parties in a timely fashion resulted in delays that resulted in additional costs to the claimant of $2110.

      4) AAA failed to provide a recording/transcript of the arbitration proceedings negatively impacting our ability to appeal the judgement and award in superior court.

      Based on the significant failures on the part of The American Arbitration Association in the administration of my claim, I am requesting the refund of all fees paid.

      Dear BBB:

      We are in receipt of your communication dated November 8,2022, regarding the complaint ****** **** submitted to the Better business Bureau. Thank you for providing American Arbitration Association, Inc. (AAA) with the opportunity to respond to this complaint. As set forth below, AAA properly administered the arbitration case filed by Mr. ****.

      As brief background, the AAA is a not-for-profit 501(c)(3) organization founded in 1926. The AAA is dedicated to fair, efficient, and economical methods of alternative dispute resolution, and it provides a brad range of dispute resolution services, including administering arbitration cases, through offices throughout the United States and one office in Singapore, as well as through cooperative agreements with arbitral institutions throughout the world. As to arbitration cases filed with it, AAA is the neutral organization that administers the cases, and the arbitrators on those cases decide the parties' claims and defenses. 

      Mr. **** filed an arbitration case with AAA in June 2021, and he was represented by counsel through out the case. The arbitrator appointed to the case decided the substantive claims and defenses at issue and rendered the award. If either party were dissatisfied with the award, they may to seek to vacate the award in court under the relevant state's arbitration statute or the Federal Arbitration Act.

      With regard to some of Mr. ****'s specific complaints:

      As was noted in AAA's cover letter transmitting the award to the parties' counsel, AAA reconciled each party's finances and sent refunds of unused arbitrator compensation deposits to each party's counsel shortly thereafter.

      AAA timely responded and provided information to Mr. ****'s counsel regarding requests to clarify the award, the appellate arbitration process, and challenging an arbitration award.

      Pursuant to AAA Commercial Rule R-28, the parties to an arbitration case are responsible for arranging for transcription of the hearing, if they choose to do so. Many parties elect not to have a court reporter or to otherwise transcribe their hearings. It does not appear that either party elected to transcribe the one-day virtual hearing in this case.

      I hope this letter sufficiently addresses Mr. ****'s complaints and any concerns the Better Business Bureau may have. Please let me know if you need any additional information or have any questions regarding this response.

       I am rejecting this response because:
      Contrary to the statement made by AAA,, questions submitted to Ms. ********* were not answered in a timely fashion causing a delay in payment of the award. This resulted in over $2000 of additional legal fees paid by us. Ms. ********* also failed to provide timely and accurate information relating to award correction deadlines and submission process. Throughout the arbitration we were not provided with accurate and timely information by AAA staff.
