    Signed Contract in September 2022 with HOME WORKS *** AKA: TheHomeWorksInc.com. They installed Artificial Grass in the front of my house and Putting Green grass on the side of my house and small strip in the back of my house. As I was not home during this time, it would appear they crew did not use tarps as rocks and trimmings from the artificial grass landed all over my front yard but also in my neighbors yard. I have sent a picture from a failed capped sprinkler, and it still has not been fixed. When the crew was working the side of the house they left a huge pile of dirt from the project at the back side of my yard near the back fence. They also left a mess in the **** I have that divides my back yards. I continue to pick up rocks that are in my backyard where I have regular grass growing. The walkway at the side of the house is not level with the bricks which is a safety hazard for me. Somehow the crew did not leave a drain in the walkway. I have pictures I want to send but I do not know how to upload them and when I tried I lost the data I had already written. The lead Project Manager is ********************* and I have had a time with him trying to communicate with me on the project. This company would also take payments out without my consent. It may be next week when I could get some help to upload the pictures I have/

    The issues  are contractual issues. Our work is completed and per the contract.

    Please see latest communication to the client based on her  failure to pay and  site inspections completed.

    The  complainant has breached the contract. Failed to pay as agreed, work is complete, and complainant is "stretching" to create an issue that does not exist.

                                         We have performed as per the contract.

                                         All phone calls have been returned. From this point forward, any communication form you must be in writing only.

                                         If you have in fact "cancelled "the final payment as per your email of today's date,  and as was authorized by the signing of the Credit Card Authorizations agreement before work commenced,
                                         You are then in violation of the contract ( Breach) which as per the contract VOIDS all warranties., per the contract as agreed to.
                                         In fact, cancelling the payment constitutes a Civil Fraud, and Breach of Contract.  It is up to you to decide if failing to pay per the contract is worth losing your warranty provided for , and
                                         subject to full payment as per the agreement.


                                         Per the contract, Water leaks must be reported within 7 days. This report of a water leak is nearly 2.5 months after the front yard areas were completed.
                                        There was no evidence of leaks or reported by you in the limited time frame.   Thank you for the photo

                                        Rubber marks on your drive way from some vehicle does not constitute a breach of contract or actual damages, and could have been caused by your vehicle
                                        or other visiting vehicles.  Thank you for your photo.

                                        Dirt in back yard when we began work, remains in your back yard. Thank you for that photo confirming this.

                                        Lastly, the photo of the bubble level is interesting, yet fails to show your paver door stoop is completely out of level , while confirming our surface is in fact level.     Thank you or the photo.    


                                        Unless and until you can confirm the last payment is PAID, your warranty is VOID and no further services will be rendered.    

                                         In conclusion, it appears you are stretching to find issue where issues do not exist, and creating circumstance resulting in (at minimum ) the loss of your warranty.

    Morning *****,

    The last payment was cancelled as the work is not completed (as you have stated), from the lack of communication from you on the projects but also how "The Homeworks **** made payments/charges without my consent.  

    As you can see from pictures, your crew not only did a very lousy job with the back, but also left tire marks on the driveway,walkway on the side of the house is not level, the drain/outlet is also missing in the walkway.  In the last picture is the sprinkler going off in the front which should have been capped.  There is also a picture of the crappy dirt your crew left next to my back fence witch I had talked with you about. 

    I also have pictures of the artificial grass left behind in the front and rocks in the neighbor's grass next door.  When are those going to be cleaned up?

    You have said the work is complete - which is a false statement.  Take a look for yourself.  You chose not to return my phone call or take a look at the crappie work weeks ago from your crew.

    I am rejecting this response because: Work still needs to be done.  As I am not able to download any of my emails,  I have forward 3  different emails to Mr. ************************* showing what still needs to be done but also of a video of how the ground is not level with the "island" of the walkway next to the house. I can provide more emails upon request.  Grass & rocks needs to be taken away in the front.  Sprinkler head in the front needs to be capped.  Walkway at side of house needs to be level to the pavers per contract.  Dirt taken from side of house, placed near back fence needs to be hauled away.  Only one (1) site inspection was given - back in June/July very firsts step of the project.  As there is still work to be done, and no inspection has been made to say the work is complete, I cancelled the last payment.  I can be reached via email if you have any questions.  Thanks  ******************s
