    I hired C**** *********** of Bertilacchi Landscape for a landscaping project at my home in San Luis Obispo, CA, paying him $96,000. Throughout the project, he repeatedly requested payments from my husband, a retired physician with dementia, without providing clear invoices or itemized receipts. We trusted him but now believe he took advantage of our trust and my husband's condition for financial gain. Chris abandoned the project before completion, forcing us to hire another contractor at our own expense. His invoices were vague, and we later discovered he used leftover materials from other jobs but still overcharged us. Despite full payment, he never returned to finish the job, leaving us with an unfinished courtyard, untrimmed plants, and unresolved construction issues, while ignoring multiple requests for a clear timeline. Under California law (BPC § 7159.5), home improvement contracts must be in writing, yet Chris never provided one, making his charges questionable. Due to his abandonment, we had to hire another contractor, incurring additional expenses, including new contractor fees, $145 for dead thyme plants due to improper irrigation, $100 for plastic materials I sold him but was never paid for, and pressure washing costs after his crew left my pavers unusable. Chris’s failure to complete the work, fraudulent billing practices, and possible elder financial abuse have caused us significant financial and emotional distress. I am requesting a refund of at least $50,000 for overpayments, incomplete work, and additional costs incurred. If unresolved, I will file a CSLB complaint, pursue legal action, and report him to Adult Protective Services (APS) for possible elder financial abuse. We trusted Chris, but his lack of transparency, failure to finish the job, and financial exploitation must be addressed.

    Attached you will find a proposal dated 4/14/24 singed by D**** *********. After many meetings and changes to the project scope I directed D**** to a Landscape Architecture firm. 8 months later D**** came back to me with a new plan which I proposed and her husband Paul signed on 12/12/24. Please note the schedule of payments identified on the bottom of the proposal.

    The job was completed in full and D**** willingly, unscripted, provided and wonderful testimony of her new outdoor living space and her experience with my company. My company went above and beyond for P*** and D****. I will forward D****'s testimony now.
