I began working with this company after applying for a debt consolidation loan and getting denied. I was contacted by the as an alternative. The first year was fine. Aside from I didnt realize until just recently what their fees were. They never discussed that over the phone. Only put it in their super long contract you were encouraged to sign quickly to get things started. They were making settlements no issue, a little slow in my opinion, but thats neither here nor there now. I have one specific creditor, **************** that they have told me from the very beginning they were attempting to settle. I even sent them 2 emails I had received from credit one showing settlement offers they were personally making towards me with an assurance they would try to get it settled. About a month and a half ago I called guardian to let them know I was prepared to send them an extra $2000 to help settle more accounts. I agreed with the person I talked to that we would use the extra money to settle the Credit One account and one other one. On my monthly phone call later I asked them where that was at and they said they described something to me about what the funds were being used for. I expressed I didnt understand what he was talking about but he just blew me off. Well the next month I receive my statement for my account and see that I only had less than $100 in the account and no more settlements were made. I called them and after getting the run around was told that they used the whole $2000 to pay their fees. I have expressed multiple times that I did not authorize this to happen. They dont care and have told me itll just help get settlements paid in the future. Fast forward to last week and now I get a summons in the mail for Credit One for my debt. Now I need to pay an extra $200 for the state filing fee for guardian to represent me and the creditor wont talk to me.

    Dear BBB:

We appreciate the avenue to respond to Ms. *********** concerns.  When our firm was retained, we explained our earned performance fee to her in detail.  It is further visible to her when she accesses her set aside savings account portal online.  She agreed to payment of our firms earned performance fee when our firm was engaged. The majority of Ms. *********** debts are already under settlement.  Unfortunately, regarding the account that she mentions is now in litigation, no settlement agreement could have been obtained prior to the lawsuit because Ms. *********** deposits are being fully utilized to pay for existing settlement obligations.

Regardless, we are confident that we will negotiate an agreeable resolution for the debt that she has been sued on.  These lawsuits are not new to us, and our firm has successfully settled thousands of similar cases.  We ask that ************************ contact our office with any questions and look forward to getting her remaining debts settled.  Our commitment to getting her out of debt has not changed.  Thank you for your attention.

I signed up to this company in August 2023, 1st payment on 9/14/2023 to consolidate debt on 4 credit cards i was making the minimum payments on, in hopes of getting the advice and assistance to pay this debt down faster. At the time i signed up, i had an excellent payment history on these 4 CC accounts. I was advised by the representative at the time that " i would need to stop making my payment, so that the creditors would be willing to negotiate y debt". his literal words. I expressed that that would be hard because i was proud of my payment history. However, trusting the "professionals", i stopped making the payments. The company was great in making the monthly contact and updating me about the process. The problem occurred when i learned that they should not have advised me to stop making my payments. After reviewing my Credit report and seeing that my score had drop nearly 300 points since October 2023. I started talking to other debt consolidation groups and was informed that not only was this bad advice, it was ILLEGAL advice. I contacted Guardian Litigation Group to address the matter and was made to feel like I was lying and chose to stop making payments. the representative then told me that "it was optional to stop making payment, but the creditors are more willing to negotiate if my accounts were delinquent". i explained that the representative who did my intake literally insisted i stop making payments and never "suggested" I stop. At this time I explained that i was disappointed in the way they handled my intake and that I had a perfect payment history until i was told to stop making my payment for a better chance at getting the Creditors to settle. The representative then brought up an old account from over 7 yrs ago that I had paid off, in full, and then closed that account. This account is not one of the accounts they are attempting to consolidate because IT WAS PAID OFF OVER 7YRS AGO. Doing business with them has destroyed my credit further.

    Dear BBB,

Thank you for the venue to respond to ********************. As of the date of this correspondence, our firms supervisory personnel have attempted to contact ******************** on no less than 2 occasions over the previous 3 days.  To clarify, our firm was not retained by her to consolidate debt.  We do not provide loans.  The scope of our services was made abundantly clear during our initial recorded calls with ********************.

It was further reiterated to her during the execution of our agreement, which details that fact that we were engaged to negotiate and settle certain unsecured debts for ********************.  She also expressed understanding about the additional disclosures we provided regarding debt settlement, including, but not limited to, the negative impact on credit.  She was never informed to stop paying her creditors.  ******************** was informed that debt settlement is for those who are in financial hardship who are unable to pay their creditors.

To date, our firm has already negotiated well over 1/3 of ******************** debts.  We would welcome the opportunity to speak with her and address her concerns.  Our supervisory personnel will continue to reach out to her to finalize a resolution.  Thank you for your attention.

I was told they would help settle my debts. I should stop paying my accounts. They would put the money I'm paying in an account where I would then pay the settlement amounts. I have heard of one settlement, but there has been no money placed in this account to make the payment. It is coming up on my third scheduled payment to them and now I cannot access the web site to schedule payment.

    Business Response

    Dear BBB:

We appreciate the opportunity to reply to **************.  As stated correctly by her, our firm was very recently retained to negotiate and settle certain unsecured debts.  We do not ever instruct clients to stop payments to their creditors; debt settlement is an aggressive form of debt relief that is for clients who are in hardship and unable to pay their creditors.

************** is correct in that we have already placed one of her debts under settlement. However, she does not need to access a website to set up the settlement payments.  She has already authorized the settlement payments to be made from her set aside savings account, the first installment of which has already been paid.

In fact, her next settlement is already in process and we anticipate calling her to authorize it in the next 5-7 business days.  Our firm will be reaching out to ************** to ensure she understands this part of the debt settlement process and is able to fully utilize the web portal which displays her settlement payments. We would urge her to contact us in the meantime with any questions. Thank you.

We appreciate the venue provided to us to respond to ******************************.  On 9/13/23 he retained our firm to negotiate and settle 5 debts.  Our firm settled one of his debts on 11/30/23 and we are currently working on the settlement of his second enrolled creditor account.  He has not been asked to add any additional funds, and if he would like to apply for a debt settlement acceleration loan to speed up his program, he can absolutely do so.  We spoke with ****************************** on March 18, 2024 and reviewed his program.  We will also be reaching out to him today to ensure the information above was clearly relayed and that he has no other concerns.  Should he have any questions in the meantime, we ask that he contact us and ask to speak with a Team Lead. Thank you for your attention.

The company say they consolidate debt but have not done anything for 7 months. I was told to stop paying the loans involved and due to this my bank account was locked until I made a payment to a loan causing me to be able to pay other bills. When I check the status it shows nothing has been done. When I call it goes no where. Now my credit has dropped dramatically

In November 2023 I was contacted by Guardian to resolve my credit card debt and have been paying guardian litigation to resolve my debt and turned over numerous credit accounts with only one resolved.. I am now receiving letters from my debtors saying to pay them. only one account has been settled (charged over $600 to settle one acount) and it has been longer than six months, nothing is being done and I am paying guardian litigations and creditors are trying to resolve accounts with me through emails and was told to forward Guardian those letters and such. My credit is getting worse and nothing being done. I have emailed them and havent gotten any response or any kind of notices of settlements. I may have to now seek legal counseling and pay them.

Thank you for the opportunity to respond.  ************** first settlement took place within the average time frame for first settlement that we expected and his debt resolution program is moving forward in accordance with our initial estimates.  We have remained in consistent contact with him and have communicated responses to all his inquiries.

At the time of this writing, our firm is actively working on a second settlement for **************.  We are confident he will be pleased with the results.  The amount he described as in dispute is the balance of deposits to his savings account, which will be applied to the next negotiated settlement.  We do anticipate completion of his next settlement within the next 5-10 business days.  We ask that ************** watch out for a call from our staff to authorize that settlement and reach out to us in the meantime with any questions.  We are also going to ask that a supervisor reach out to ************** immediately.  Thank you.

I contacted Guardian Litigation Group to help with consolidating my debt. They told me that they would negotiate with my creditors to settle my debts, and that I would pay them one monthly payment and they would distribute the funds to my creditors. I was quoted a payment amount. After one payment was made, they contacted me saying that they had settled one debt and that my payment would be going up by $200 a month over what I was quoted. The debt with that creditor was never paid. Fast forward 5 months and none of my other debts had been negotiated at all. When I told Guardian that I wanted to cancel, they told me I owed them $1800. They did not do what they said they would, so I told them I refused to pay. Then a couple of months go by and I decided to go ahead and pay them to get it off my credit, and now theyre telling me I owe them over $3200. I asked for them to provide a written statement as to how they arrived at that number and was told they could not do that. Im not blindly shelling out over $3k without knowing what its for. Bottom line is that they did not provide the service they were contracted for.

    Business Response

    Date: 03/29/2024

Thank you for the opportunity to reply to ****************.  She retained us to negotiate and settle certain unsecured debts.  Unfortunately, our firm had to disengage from the agreement after she stopped making deposits to her set aside savings account.  Even though **************** only made 1 successful deposit out of 5 attempted deposits, we still managed to negotiate a settlement on her largest single debt.  She contracted our firm to settle $18,765 in debt for her. Within the first month of the engagement, we entered a settlement on $12,010 of that debt.  **************** explicitly authorized the acceptance of that settlement via text message.  Her single cleared deposit was applied to that debt and our firm was paid $3.20.  She was provided a full accounting statement which reflects these amounts from the administrator of her set aside savings account, Forth Pay.  **************** program was progressing incredibly well, and we would be happy to welcome her back so we can finish the job we started.  We do not charge our clients a fee until we settle.  Regardless of what she chooses to do, we wish **************** the best in getting debt free.

    Customer Answer

    Date: 04/05/2024

I have formally asked for an itemized statement of how Guardian arrived at the $3245 they say I owe them (after I was first told $1600). They let my debts get behind over 4 months, effectively sending my credit score from 600 to 430. They have not complied with my request for a mailed statement. I also asked for them to send a letter to one main to let them know that I am no longer working with them. I was told it would take 2-3 business days. Two weeks have gone by and one main has still not received that letter.  Guardian is nothing but a scam.

    Business Response

    Date: 04/05/2024

    Dear ****************:

Please contact Forth Pay, the administrator of your set aside savings account, at ******************************************* via phone at ************ for the accounting statement you are looking for, as well as online access to that statement.  Forths statement (as well as your regular bank statement) will confirm that you made a single deposit to your set aside savings account, and that most of the deposit was applied to a settlement payment for your debt with One Main.  It appears that you are now contacting One Main directly to reap the benefits of the settlement that we negotiated on your behalf.

You verbally agreed to our contingency fee during your initial quality control call which took place on 9/8/23.  That fee is 27% of the balance of the debt being enrolled.  You also agreed to the fee in writing when you executed the agreement with our firm on 9/8/23.  The negative impact on credit was also explained, verbally and in writing, and you agreed to same.  We have already sent One Main a revocation of our power of attorney.  We wish you the best of luck in getting debt free.  Thank you,

    Guardian Litigation Group

    Customer Answer

    Date: 04/08/2024

No, I SENT ONE MAIN A REVOCATION OF YOUR POWER OF ATTORNEY! I asked for you to send it and was told that it would take 2-3 business days, and then 2 weeks later I had to send it to One Main MYSELF since you lazy humans couldnt be bothered to do it. I was told by One Main that there had been no negotiation, and that as soon as they received a revocation, I could begin to work with them on a settlement plan. The public needs to be informed that they can call their debtors themselves and do the same exact thing that you are SUPPOSED to do on our behalf, but that youre too lazy to do while letting our credit tank and calling us to coach us on basically ignoring their calls.

I signed a contract with Guardian Litigation in April of 2023. They agreed to settle all of my credit card debt for the sum of $40,000.00. I agreed to pay $836.11 per month for 4 years. So far I have paid them $10,032. They have settled two accounts and are paying one down. They have now asked me to pay an extra $500.00 to pay Discover card. I do not have any extra money and struggle to pay the monthly premium at the current rate. Guardian has not settled the Discover card account and now I am being sued by Discover who is threatening to garnish my wages. I am a retired person and have limited income. Guardian charges me $500.00 in monthly fees and states they do not have the funds to pay Discover card. This is a lose-lose for me because so long as they are charging me so much in fees they will not be able to settle the rest of my debt. This is not what I agreed to initially. The contract was I pay them $40,000.00 and they would resolve all my debt. I want a refund I do not trust this company and think they prey on the elderly. Please help me.

    Business Response

    Date: 03/27/2024

    Dear BBB:

Thank you for the opportunity to respond to ****************.  Our firm was hired to negotiate and settle approximately $50,000 of her unsecured debt over the course of an estimated program term of 48 months.  To date, we have placed approximately $26,000 of this debt under settlement for slightly less than half of what was owed.  Most of Ms. ******* deposits to her set aside savings account have been applied to these negotiated settlements. Although she is only 23% into her program term, our firm has already aggressively negotiated and settled 52% of her enrolled debts.   Our firm does not regularly charge her $500 in monthly fees.  Weve allowed for our contingency fees to be spread out over the term of her program.

We are confident that we will be able to negotiate a settlement on the account that **************** has been sued on.  She has already spoken to her attorney, who has appeared in the matter on her behalf, and negotiations with the creditors attorneys are underway.  Our firm has negotiated and settled thousands of similar cases and we ask that **************** remain patient and maintain communication with us while we perform the job she hired us to.  Our firm has a variety of strategies to glean additional time for her to build savings while we negotiate the lawsuit with opposing counsel.  Based on the information provided in her complaint, she is of the belief that she is paying our firm $40,000.  This is not accurate, and we will have our supervisory personnel reach out to **************** to clarify her concerns.  Should she have any other questions we ask that she reach out to our firm directly.  Thank you for your attention.

    Customer Answer

    Date: 03/29/2024

I pay $836.11 per month for 48 months equals $40,128.00 so I do not understand how Guardian can state that I will not pay the stated sum. This is not true, I will pay over $40,000.00. However that is what I agreed to and do not dispute this. What I am disputing is that Guardian is requesting an extra $500.00 to settle my Discover account. As I stated previously I do not have extra funds. I have recently been diagnosed with Breast Cancer and will be out of work for at least 3 months. Furthermore even that not withstanding I will not pay an extra sum when our agreement is that I would pay $40,000.00 and Guardian would settle all of my accounts. This was carefully explained to me when I initially signed the contract. Also Guardian does charge me $500.00 per month and I have an invoice from FORTH to substantiate this fact. I do not appreciate Guardian stating that what I have claimed is not true. Therefore I would like the BBB to confirm receipt of fax From The Breast ******************** and a statement from FORTH proving that I pay Guardian $500.00 per month. Please provide a fax number so that I may send these documents.

    Business Response

    Date: 04/02/2024

    Dear ****************:

Your previous message stated that so far you have deposited $10,032. We clarified in our response that you 1) have not yet paid the total estimated amount of $40,128 and 2) that you are not paying Guardian this amount.  Please remember that, as we explained when you retained us in our welcome calls, our quality control calls and, in our agreement, that this amount is an estimate based on our previous results for other clients.  It is not a guaranteed amount because individual results always vary.  With that being said, we are still making good progress and your results to date are relatively close to that original estimate.

The additional $500 that was requested from you was for payment of the lawsuit we are settling for you.  From what we see in our most recent notes, after our most recent call you were informed that our firm has further deferred its fee collection for you to help with settling this lawsuit.  The $456 fee that was charged to you in April and March is not the same every month. Our fee collection schedule fluctuates monthly based on each clients settlement payment schedule.  The reason for the fluctuation is to allow you sufficient time to pay the fees you owe to our firm. For example, although weve already settled $25,875 in debt for you, we have only been paid 55% of the fees we are owed for those settlements.  The remaining fee amount that you owe has been placed in deferment so we can help you attain additional settlements.  We trust this message answers your questions. Should you have any other questions, please call in and speak with the Team Lead that weve assigned to your file.
