    On July 5th, 2022 I entered into the monthly discounted membership contract for 12 months with Nonstop Fitness in ***********. I moved out of town (to Roseville) on June 30th, 2023. I called Nonstop Fitness on July 7th 2023 to cancel the membership and there was an automated message that said there was a 30-day written notice policy for cancellation (contrary to the wording in the contract which states 15-day notice) so I emailed the address provided in the automated message requesting to cancel on that same date, July 7th, 2023. In the contract that I have access to, it states that after the initial membership period expires, it renews on a month-to-month basis, not a 12 month contract. However, when they responded to my cancellation request, I was told that there would also be a $200 cancellation fee since I had auto renewed into another 12-month contract and ending that earlier would be cause for a cancellation fee. I was unaware that I would be auto renewed into another ***************************************************************************** of an auto-renewal within **** days before auto-renewal, which they did not. In fact, it says that I auto-renewed on June 21st, 2023, before my 12 months had expired. It was also my understanding that they had to receive affirmative consent from me prior to charging my debit card for an auto-renewal, as well, which was not done. In addition, she sent me a copy of a contract that she has on file for me that she is claiming I signed, but it is not the same one that is shown on my membership page. I have not received any communications from Nonstop fitness since July 2022, regarding any changes in the contract. She has agreed to honor the $50 cancellation fee that my version stated, but it is not right the lack of transparency in any changes to the contract. I have attached the copy of the contract that I have and a copy of the contract that Nonstop Fitness claims to have on file for me.
