On March 13th, 2025, ***** ***** entered into an ******************* Agreement with Estate 360 Inland Empire (Riverside County Estate360, LLC) for the sale of personal property and assets located at **********************************************************************************************************************************The sale was completed around April 11, 2025. According to the terms outlined in the ******************* Agreement, specifically in Section 15, "Proceeds From The Sale," the seller (***** *****) was to be paid within 30 days following the closing date or the end of the removal period during which the items were paid for by the ********* of today, ***** ***** has not received the payment owed. It has been confirmed through discussions with **** ******** that the total sale amount of the items was approximately $8,000. Date of Transaction: Auction Ended Jan 223rd, 2025. Payout to estate holder per contract was to be 30 days after auction ended.The company retained all the proceeds from the sale (auction). Total documented auction dollars was *********. Customer to receive ********************************* was committed to paying the seller, 60% of total sales for all items sold, except vehicles, in which the seller received 90% of the proceeds from the sales and Estate 360 received 10%.The dispute is that ********** has failed to live up to the signed contract and thus far has not paid the seller the agreed upon amount following the end of the business event. Seller has received zero compensation following the end of the auction.The seller has been in contact several times via phone and text. Estate 360 has not followed through on their commitment. I am rejecting this response because:If your enclosed response is from ***** ****** of Estate360 of *******************, he is the owner of the parent company. This is stated on the company's website and on his Linkedin business profile page. The address listed is ****************************************************. He operates an *** for the Central Coast branch of the company. The *** for the Riverside County Listing (covering the ************* area) is operated by ****** and ****** *************************, **. I had entered into a business arrangement with the Riverside County branch of Estate360.The company's marketing website ************************, encompasses the entire business network and has contact information for all locations. The site presents the business as a unified entity operating under one umbrella. In fact, I have spoken to a gentleman named **** at **************, on three different occasions. He has communication, and relationships with ***** and the **********, as he serves as their telecommunication specialist when you call to inquire about conducting business with Estate360. A part of his responsibilities is to resolve customer issues. He told me he spoke to ***** and ****** about my circumstance, and they are both aware I had not been compensated per the agreed signed contract. My last conversation with **** was on 3/15/2025. Based on ******* response, he is presenting himself as totally non-affiliated with ****** and ****** ********. I'm certain he knows full well, and has full knowledge of where, and how the ****************** conduct their business endeavors. I have also attached the last text from ****** ********, in which she continues to claim that payout is to come from the "main office" (***** ******) and they, (her and ******) are not responsible for payout to clients. I can also supply other text that puts the responsibility for payout to clients, in the hands of ***** ******.

I met with ****** and **** in Dec 2024 ,a month after my mother passed away, to sell the items in her home. They explained that they have a very established business and that we would have the proceeds from the sale within weeks of closing. I signed the contract with them on 1/9/25 which states:15. SELLER WILL BE PAID WITHIN (30) THIRTY DAYS AFTER THE CLOSING DATE OF THE REMOVAL PERIOD IN WHICH YOUR ITEM(S) ARE PAID FOR BY THE BUYERS. IF YOU HAVE AN OPEN Estate 360 INVOICE (CURRENT OR OVERDUE) AT THE TIME A SELLER PAYOUT IS SCHEDULED, Estate 360 RESERVES THE RIGHT TO APPLY UNPAID INVOICE(S) TO THE FUNDS DUE TO YOU.They split my mothers home into 2 auctions. The first began on 1/28/25 and the last concluded on 2/21/25. They did not call me to tell me the sale was done and they were out of the house, but instead texted me the following Monday, stating that they left the key to the front door on the porch in a bowl. I instructed them to finalize the inventory and send it along with the payment. On 3/3 I inquired into when I should expect these things and ****** texted stating she would check with the office and get back with me. I had to reach out again on 3/4, only to receive a response on 3/5 stating the check will go out at the end of the week. On 3/17 I reached out again letting them know I had not received the check or inventory. ****** gave me the name of someone name ***** and 2 numbers. When I called one, a voicemail for ***** picked up but the mailbox was full. When I called the second a voicemail for estate 360 picked up, I left a voicemail and received no return call.On 3/19 I reached out again to ****** by text and again called the numbers she had given me. I received no call back but did get a text from ****** stating she would get this resolved one way or another. Today is 3/28 and I have not heard from anyone since. Even after multiple calls, emails and texts. Proceeds from the sales were $4000 and $6200. I am requesting 60% as agreed .Business Response

I contracted Estate 360 to sale items located at ******************************************************. The sale concluded 1/27/25. The contract stated that I would receive 50% of proceeds from sale. I never received an accounting of sales. Most of the items were sold. I estimated that total sales were $6,000-$6,500. Contract stated that I would receive payment within 30 days of sale. It has now been over 60 days, and still no payment. I have reached out by phone, text, email, but to no avail. I am hoping you can assist me in receiving the funds I am owed from the proceeds of the estate sale. Shame on them for taking advantage of grieving families and friends.Initial Complaint
