      Complaint Summary:Sonny Builders has stolen $5,000 from **, and will not return it. How? Sonny Builders illegally charged us an "upfront phase payment" totaling 1/3 of the total project budget. Sonny Builders performed poor quality work, disappeared for weeks until we hired a lawyer to write them a letter, then quit without finishing the remaining work the upfront payment was for. Sonny Builders will not provide us with the owed remaining funds.Details:Sonny Builders *** was hired as a contractor to perform landscaping, yard work and construct a fence at our home in *********, ********** on August 17, 2022. Sonny Builders front loaded a vague 'phase payment' with a description of 'once start for material/labor', which I paid being a naive and trusting first time homeowner. It seems standard practice for them. We have another contract with them, prepared by a different individual back in May 2022, that does the same thing. We have a large project with them (install pavers, irrigation, drainage, grading, lawn and rebuild a fallen fence in same style as existing). They were supposed to provide designs for new work, but a month later they still had not delivered us anything. We decided to move forward with the fence work since that did not require HOA approval.The fence work was of very poor quality. The posts were not evenly spaced, leveled, or buried deep enough, and the fence itself was over the maximum 6ft HOA (and building codes) allows. Then mid way through they disappeared, not sending any workers or responding to any calls or texts (to multiple people) for weeks until we engaged a lawyer to write a threatening letter.They have since partially fixed the height and some other issues with the fence.Finally, they announce that they would not finish remaining work. Due to their bad work quality and bad communication we are willing to mutually break the contract. However they are not willing to return to us the remainder of the unused funds.

      Deposit of $1,000 paid. Cost of fence $16k. Vague upfront 'phase 0' payment of $20k paid. We have paid $21k. The remaining funds need to be returned since Sonny Builders has quit work those funds were to be used for.

      $5k refund and mechanical lien release requested.
