    On 5/10/24 and today, 5/13/24 I received emails from ********************* threatening that their client was going to file for use of my business, Elk Mountain Wellness, LLC (registered business in ** since 2018 and in ** since 2022) with the ***** and I must stop using my business name. I called today and the front desk clerk said ***** was unavailable and his assistant said to reply to the email they sent me today and ***** would arrange a phone call if he felt it was necessary. I asked to speak to this assistant, who was named ********. ******** could not provide me with concrete information about his business, grew furious, screamed at my husband and me when we began pressing him for information on the client and the legitimacy of their business. Below is a portion of the email they sent today (5/13/24). I had to delete content in order for it to fit here. I believe this is a scam/spam. However, I absolutely do not want to lose the ability to use my business name. I appreciate your timely assistance.Dear *****************************,Hope you are fine,This is our final attempt to contact you regarding the registration of the brand name "Elk Mountain Wellness, LLC" If we don't receive your confirmation for registration today, we'll proceed with the other applicant, potentially resulting in the loss of your right to use the brand name.Trademark infringement carries serious consequences under civil laws. Lawsuits over trademark infringement may require you to cease using the trademark and return any profits made from its use, or pay substantial monetary damages.Considering your long-term use of the brand, we have the flexibility to decline proceedings with the other party, especially if they're a start-up company.
