      Jacque ****** from Jacque's Company *** in ****** refused to meet with me to give me the keys for a rental property in ****** that she had just finished approving. We had finish contract signing, purchased rental insurance, deposit of $1,500 and I was taking the first month rent $1,200 with me on Thursday November 3, 2023. Had an appointment with ***************** at 4PM. Driving from ****** to Madera, the traffic was very slow going through ****** and I arrived at 4:09PM. ***************** refused to meet with me. Told me to return on the following Monday 6th of November. I had to pay the rent where I currently am living. She told me the property was no longer available and kept my Deposit for $1,500. I am sorry to say this, but I cried because I need that deposit she kept to be able to rent somewhere else. Jacques and Company *** has no respect for tenants or clients and exercise an a enormous abuse of Authority. Treats people by making them feel belittled. This Jacque ****** and her property management don't deserve anyone's business. They made me purchase rental insurance from her friend next door, *************** with a *********************. I had purchased through Progressive and she refused to accept it.

      I have attached the email from ********. As you can see his complaint is untrue just by reading his email. Our office including myself have been kind, patient and helpful to ********. Even going beyond helping with the insurance required for all our tenants. First, let me start off by saying that ******** was only a co-signer on this lease and not a tenant. On this day of move-in, ******** verbally abused my staff member over the phone and cancelled the move-in. I sent our contracts for signatures prior to move-in time and since he had not signed due to one reason or another from him. He decided to sign them after his original move-in date. I did not make any appointment with him to pick up keys for a new move in date on November 6, 2023. His filthy digesting language was totally inappropriate towards my staff member. On his original application it specifically states:  If the property is held for the tenant and then canceled by them that their deposit is 100% non-fundable. With this he continued to move forward with a move-in date and bring in his deposit in full. If this was the case was reversed, to where the owner canceled a move-in, applicant would hold the same authority to the owner as well. As you can see the attached email that ******** canceled the move-in and waited to sign contracts after his original move-in date. I have not heard from the actual tenant named on the application since the cancellation. So, was ******** going to move-in to the property all along or was he really just a co-signer? If ****************** continues to spew lies about this matter, I will contact my attorney and file a Cease and Desist regarding his lies. I can and will submit all documents as needed to represent my case including releasing the other applicants information and bringing them into court.

      I'd like to apologize for getting upset with your assistant last Wednesday on my way to your office. You two have been very nice and very helpful with us
      and it's not anyone's fault when things don't go well on our part.  We understand that you as a property manager have the responsibility to protect your client, the property owner and us, your tenants. It's no one's fault that I didn't get there on time last Wednesday. I'd like to ask you to please forgive  me for telling your assistant that I was cancelling the contract. I don't want to lose so much money and my nephew needs to rent the home on 16th Ave.  All the contracts you sent via email have been signed and I have printed it. The propane agreement has also been signed. I believe that AuthentiSign has notified you as they have notified me. I will pay you the fist month's rent to through November 30th. I also thank you for working with **** next door to accept half payment for the renter's insurance policy. I will finish paying it by next Friday. Would you be so kind to call me in the morning to let me know at what time I may go to your office on Monday to pick up the keys for he house on 16th Ave ?  Again, thank you for all your hard word and for being kind to us.

       I am rejecting this response because:

      Mrs. Jacque ****** is the one who told me that the property was no longer available and that the deal was off. As you can see on the letter that I sent to ***************** where I ask for a time to pick up the keys on Monday the 6th , I am expressing the kindest manners that one may express. If I had cancel the appointment the contract, I wouldn't be asking for a time to pick the keys up. Yes, I was the co-signer not the tenant but it was with me that ***************** was dealing with. Jacque and Company is attempting to to keep $1,400 that doesn't belong to them. I didn't wait to sign any contract after the move in date, the contracts were not in my email to sign. And....yes, ***************** had made an appointment with me on the 3rd of November to pick up the keys or I would not have driven 78 miles to get to her office 9 minutes after 4pm and she refused to see me and that's when I told her assistant that their behavior towards me was an abuse of authority for not wanting to receive me 9 minutes late. I was driving through ****** when the call took place. During that weekend I sent the letter that ***************** attached to with her response. As you can see on the letter I was kindly asking for a time to pick up the key on Monday the 6th. Jacque and Company told me that the property was no longer available and cancelled the contract, not me.  ***************** actions in voiding the rental agreement and keeping the entire deposit of $1,400 is "steeling" and it's illegal. The period in which the deposit should be refunded to me is over. ***************** doesn't have to deal with me if she doesn't want to but will be dealing with the  DFEH and with the ********** ********** of ************ I don't want to fight or argue about what is legally mine. I want my deposit back on the Rental Agreement that she canceled.
