    in 2018 I acquired solar panels to my home. the company filed for bankruptcy during the process and another company named Triphecta holdings took over. my only point of contact is **** *******. and from the beginning he told me nothing would change, the contract was the same. I still felt leery about it and had to convince him to send me a new contract with the new companies name. also, there was no way to make payments except by check or money order. and when I asked about statements I was told they don't send monthly statements. after pushing the issue, I received an email with a years worth of statements for the year of 2020. I haven't received anything since. now currently im in escrow on selling my home and buying a home, and **** has been very difficult to contact, and is not willing to provide a more thorough contract to the buyer as they requested, nor is he willing to provide a reassessment of solar to provide to the seller per the solar contract, and California regulations.
    this is costing me a great deal since I can't sell my home with the cooperation on Triphecta holdings part, and if I can't sell my home, I can't buy the new one we want, and escrow was to close in just a few days on both homes!! I don't feel **** or Triphecta holdings is adhering to their contract or state regulations/codes/standards/or law (whichever is applicable) and id like his company investigated.and id like the solar removed at no cost with repairs done at no cost to me or the potential buyer of this home. I've been a good customer and have had no one uphold the contract on Triphecta holdings end. no ones ever come to maintain the system which is also in the contract, and per the contract, its also monitored which we've never been given access to or told about as the contract states we should. I've tried looking up this company with very limited information available, and certainly doesn't come up as a solar company.

    In 2018 ***** Warren signed a 25 year lease with Triphecta Holdings for a solar system to be attached to her home and the power generation that was produced from this system to be sold to her at a fixed annual rate.  At this point ***** is in default of such contract and is 4 months behind in such payments.

    About a month ago ***** made me aware that she is trying to sell her home and she needed some help with the solar contract.  I told her I would be happy to help and assist with the transfer to the new owners.  I requested a credit report and contact info for the new buyers and to have them emailed to me.  I never received either.

    Roughly two weeks ago I was traveling to Texas for work and she texted me about 6:45 in the morning in a panic.  I was flying so I didn’t get the text for a couple hours and by that time I had received about 5 texts stating that I never return her texts and so on.  I then called her that morning and explained that I am traveling.  She asked me to reach out to the loan officer to discuss how I can “fix” the solar problem that she felt was holding up escrow.  I called the loan officer for the buyer of *****’s home and told me that ***** has a PACE loan which needs to be paid off as well at the close of escrow.  I asked him if he has locked their loan and he informed me that they have not even printed docs because there is no way the loan will be approved.  He told me that the PACE loan($30,000) has to be paid off but also needs to no longer show on title and that could take up to 9 months.  The buyer was not able to qualify with both the PACE and Solar on title due to there Debt to Income ration was to high.  I called ***** and informed her of what the loan officer had told me.  As far as the new contract the underwriter for the new loan was requesting that I remove the word “summary” for the lease, which I did, and emailed back.  As far as a reassessment she wanted me to shorten the timeline of the lease or lower the monthly payment upon her real estate friends request.  I declined to do that and in the contract that I sent over I extended the exact terms that she originally agreed to for the new buyers.

    I hope this clarifies some of the key components of this story that were left out previously.

     I am rejecting this response because:


    He’s not being truthful. He’s the only one telling this version of the story, nor is that a resolution.  And that’s not the only reason for my complaints against him and his company. I have already begun seeking legal help.

    ***** first reached out to me on Aug 5th at 10:24 AM.  I responded back at 11:53 AM answering her question and had a follow up question for her.  We went back and forth and I asked her to have her realtor contact me.  She then reached out to me on September 6th at 9:27 AM via email for the first time.   Then at Set. 6th at 11:06 AM her realtor texted me.  I responded back as soon as I landed as I was traveling on an airplane.  On Sept 6th at 8:26 ***** sends me a text stating "And the buyer is getting kicked out of qualifying for my house because of the solar. "  I believe that someone misled ***** into thinking that Solar was the cause of the sale being held up.  I followed up with a text to her stating the following: I spoke with escrow today and they told me they don't have loan docs.  So I called the loan officer and he said the deal is dead.  I wanted you to know as I am not sure what the sales agents are telling you.  I am sorry for the bad news but I figured you would want to know and not continue to be jacked around."  She responded "Thank you"  That is the last time ***** has texted me.  All of this can be documented with time stamps.

    Some where someone has told ***** that the solar was what caused the sale to not go through.  If you reach out to escrow and the loan officer they could provide you more detail as to why the buyer couldn't qualify due to their DTI being too high with the PACE financing as well as the solar.   The loan officer is who told me directly that the PACE had to be paid off and that is not possible because it could take up to 9 months to show on the tax records.  I am not sure if ***** has called them both directly but I think it would help clarify this for her.

    If ***** is willing to get current on her past due payments and agree contractually to having her payments withdrawn though ACH monthly on the day she prefers I will take off 10 years on the lease agreement. That is  tens of thousands of dollars as a concession in order to help *****.
