    On May 13, 2022, around 9 PM, Black's Towing was called to tow my car (2006 BMW 330i) to the BMW of Murrieta. We had called the Murrieta Fire Department regarding the smell of fumes coming from our garage, which they later deemed safe. A driver from Black's Towing arrived driving a flat bed tow truck a few minutes later. I showed him the car and he proceeded to load it up onto the tow truck and secured it. When he was done, I informed him that I wanted my vehicle towed to the BMW dealership. He proceeded to explain that they didn't have a night drop off and that he was concerned my vehicle would be towed because it had a non-operational registration. I informed him that I was the owner of the vehicle, and that I was ok with him leaving it there. He insisted that there was no drop off area (false), so I told him to take it to Pep Boys where they have an overnight drop off/parking. Again, he insisted that there were no shops in the Inland Valley that have a night drop off and insisted that he was taking my vehicle to his tow yard. Having towed the same vehicle in the past to Pep Boys, I knew he was lying. I told him, "absolutely not." At this time i turned to my daughters, ******** and ******, ages 25 and 20, respectively, in disbelief. We looked at each other in shock, we couldn't believe what we were hearing. At this point I gave him instructions to unload my vehicle, that as the owner, I didn't want him towing my vehicle, that I changed my mind. The Black's Towing driver flat out refused to release my vehicle at this and proceeded to remove my vehicle from our home, a private property, without vehicle owner's consent and without the consent from the homeowner/landlord. The driver never called his dispatch, nor the fire department, nor the police department. We spent a week trying to retrieve my vehicle but the fees were more than $1000. In August I found out they had sold my vehicle after only 42 days, without my consent/release. Is this theft?

     I am rejecting this response because:


    The information  provided by Black’s Towing is absolutely false.  The Police Department was never involved.  The Fire Department was involved because we asked them to come out, which they did, and deemed there was no hazard.  In fact, they suggested that I push the car out to the driveway, if I was bothered by the fumes; however, all the gasoline had already leaked from the tank, and evaporated, and therefore did not present a danger.  Further, the only reason the Fire Department called Black’s Towing is because they offered to call when I informed them that I wanted my vehicle repaired.  The Murrieta Fire Department, NOT the Murrieta Police Department, was the only one involved, per my request.  
    Blacks Towing states in its response that their driver didn’t want my vehicle impounded if he left it on the street, because it was late and the registration was expired.  Based on this statement, it is evident that the driver is obviously using his own discretion as to what to do with the vehicle; which implies that the Blacks Towing driver has a choice.  The statement actually supports my argument that the driver was never given a directive/instructions by the police department nor the fire department to impound my vehicle.  If he had been given a directive to impound my 2006 BMW 330i, he would have no choice but, to impound  my vehicle.  Instead, the tow truck driver does, in fact, have a choice.  He ends up making a critical decision for the owner/client of the vehicle, his client, without my consent, that’s in the best interest of Black’s Towing and the tow truck driver, disregarding my best interest,  “I don’t want to leave it on the street because the registration is expired.”  “I’ll tow it to my yard.”  His predatory towing practices,  resulted in my 2006 BMW 330i being sold 42 days later.  I paid off my vehicle, with my hard work, and had  recently had the 300k mile engine replaced with a 70k mile engine, at a cost of $3500 which, based on Kelly Blue Book, True Car, and Carfax, increases its value to $7000.
