      I engaged Tiger Eye Capital and The Ohlone Tribe of Carmel First Settlers of the Chino Valley Inc. et al in November 2021 and January 2022, respectively. ***** ****** is the CEO of both companies. I paid their tribe and companies a total of $125,000 total to procure construction funding and grants for my business, which they represented they could do. After multiple attempts to work with them - all documented in e-mail and witnesses - by November 2022 it was clear they could not deliver. When requesting my funds to be refunded - as specifically stipulated in our agreement- they refused, claiming they requested that I obtain a Letter of Support for my project from Representative **** *********s office - and that I would not provide requested letter. This one letter was required for my entire deal to get funded according to ***** ******. In truth, the item they were requesting required detailed grant information- which only they had access to - and they refused to provide. They were attempting grant fraud basically. Because “I” could not get this Letter of Support, they could not provide any grants or loan offers. ***** ****** and team refused to deliver what they were hired to do, and refused to refund my deposits upon request as they promised. Multiple letters from my lawyer did not garner any resolution. Sadly, my attorney advised to drop pursuing damages as it would take more time and resources than it was worth…. And he felt TEC/ ***** ******/ Ohlone Tribe may be under tribal law jurisdiction. I just want my $125,000 back and anyone considering their services to know they are FRAUDULENT! I see now they have an “F” rating on BBB, but they did not when I checked here back in 2021.

      I am writing on behalf of Tiger Eye Capital (TEC) and the Ohlone Tribe of ********************* of the ************ **** in response to your recent communications regarding the services contracted and the funds paid for the procurement of construction funding and grants for your business. 

      First and foremost, we regret to hear that your experience with our organizations did not meet your expectations. ****** and The Ohlone Tribe, we pride ourselves on our commitment to professionalism and integrity in all our dealings. 

      Upon thorough review of our records and the agreement entered into with *********************, we have found that:

       1.  Engagement and Services Rendered: Our engagement began in November 2021 and January 2022, during which we undertook significant efforts to secure construction funding and grants on behalf of your business. This involved extensive research, application preparation, and liaison with potential funding sources. 

      2.  Utilization of Retainer: The total sum of $125.000 paid to our tribe and companies was allocated as per the stipulations of our agreement. These funds were utilized in the pursuit of your project, encompassing administrative costs, professional fees, and other related expenses. 

      3.  Condition of Letter of Support: The requirement for a Letter of Support from Representative ***************************** office was a critical component of the funding process. Our understanding was that this document was necessary to strengthen the case for grant ******** and funding. We acknowledge the difficulties you faced in obtaining this letter, but it remained a crucial requirement from potential funders. 

      4.  Refund Policy: Regarding the refund of your deposit, our policy, as outlined in our agreement, stipulates conditions under which refunds are applicable. Given the work already undertaken and expenses incurred, we have determined that the retainer has been fully utilized in accordance with our agreed terms. 

      5.  Legal Jurisdiction: We understand your concerns about the jurisdictional complexities involving tribal law. However, our operations and contractual obligations are also subject to state and federal laws. 

      We recognize the gravity of your dissatisfaction and the distress this situation has caused. While we maintain that our actions and decisions have been in accordance with the agreement and with professional standards, we are open to discussing this matter further to seek an amicable resolution.

       I am rejecting this response because: Tiger Eye Capital produced nothing tangible as far as *****s nor financing. The entire reason provided by *********************** for this lack of success is that I failed to produce a letter of support from my local legislator. However, when contacting ***************************** office regarding this letter of support,  they requested specific ***** numbers as a requirement for the letter. Without that requested ***********, which only Tiger Eye Capital had and refused to provide after repeated requests explaining why it was needed, this requested letter all of the ***** *********** submissions were "hinging on" was impossible and illegal to generate by ***************************** office. It is an empty and meritless reason to shift fault to me as the client for Tiger Eye Capital's non-performance. My written requests and communication for the *********** needed by ***************************** office to *********************** and team is well documented, as is Tiger Eye Capital's lack of response to the ***** *********** required to generate the letter. This led to going round and round in a furiously frustrating loop, blaming me as the client for their incapability. When requesting copies of all ***** *********** records prepared and submitted on my company's behalf, they also refused to provide this *********** via a lack of no response. My requests for this *********** is all very well documented. My attorney has attempted contact with Tiger Eye to help resolve this matter and again, all very well documented and we again received nonsense,  round and round responses from *********************** with no attempt at resolution and shifting blame to me as the client. No *****s were ever awarded and their ***** ****** eventually communicated she had been let go by Tiger Eye and was no longer working on my files, even though it had been stated she would be applying for *****s until the needed amount was awarded. A refund of my retainer and a copy of all ***** writing materials prepared and submitted on my company's behalf is what I am requesting to resolve this manner. Tiger Eye stated this was a refundable deposit if they were unable to perform, which is undeniably clear they have not. They delivered nothing that they promised in their scope of work / letter of intent. This same complaint has been filed with the Native American CDFI organization *********************** was using to bolster his credibility, and his nonprofit has since been removed from there website as an affiliate.

      I am reporting ***** ****** from Tiger Eye Capital/ Blue Fire Holdings, after several attempts to contact him for my $5000 refund & I never gotten a response from him.I emailed ***** back reminding him that he assured me before me issuing $5000 that it is refundable or will be applied to the closing cost at Escrow. I have attempted to contact him via certified mail & emailed him again but was unsuccessful.I do not agree that he used up $5k for only driving by the property & taking the picture of the outside and not even checking the inside of the building.He scheduled 2x with the seller of the dental practice and building,but seller told me that ***** never showed up&didn’t even bother to call to cancel or say he already took picture of the outside. The seller told me how unprofessional ***** is.My friend helped me to contact him via emails, texts, and calls-still no response.
      I paid him $5000 upfront in good-faith that he will help me secure the loan & the grants and with his assurances. But, looking back as soon as he got $5000 he is hard to reach &didn’t even help me to secure the loan. He only found a bank Chino Commercial Bank, to broker my loan.I found out from the bank that nothing was done right. ****** from CCB told me to resubmit all documents &even asked for more documents. ****** was frustrated and even told me if I am paying ***** and he is not doing his job and not fair.I really felt left alone and confused with the process. ***** didn’t communicate well with the bank and left me to do all the work.
      The underwriter from CCB and ****** told me that they will not provide a loan for the practice and will only provide loan for the building depending on the appraisal. I was so frustrated because from the start that what I pointed out to ***** that I needed a loan for both the dental practice and building and I am not signing up if I cannot get both.
      ***** misled me.He lied for doing the inspection & having loan approval for my dental practice and building.

This involves extensive research, documentation preparation, and liaison with financial institutions, which are all time-consuming and resource-intensive tasks.

      Communication with Financial Institutions: Our team has spent considerable time communicating with ********************* and other financial institutions on your behalf. This includes preparing and submitting documents, discussing loan terms, and negotiating potential agreements.

While there were challenges in coordinating with the seller of the dental practice, these were unforeseen circumstances that we attempted to manage to the best of our ability.

       I am rejecting this response because:

      All the things he said and explained during our meeting was misleading and false information. I directly dealt with ********************** ************************* from the bank is my witness and ************ whom supposed to be the agent from Tiger that he didn't pay any after the loan was never processed. He said that I got a loan approval. But, when I directly talked to ******. They cannot provide loan for dental practice. He said there are grants to be given but none was fulfilled. He said that he did took picture of external and did research. Then he should have provided information about the practice. He told me upon signing and giving the money that the money is refundable with ************ as my witness and also relayed all the information to me. All I can say he misled me in believing that there is a loan and grants approved and I will get the down payment back if we cannot get the loan as he promised.
