    Business Response

    Date: 04/25/2023

    Response with regards to student/member ****** ******.

On January 4, 2023 ****** ****** signed up for a 12 month contract at Universal Martial Arts Center Palm Desert. Term was for **** **** self Defense classes from 1/4/2023 - 1/4/2024.  At the time of contract acceptance and signature the terms were explained to ****** ****** and he was in agreement when reviewed verbally followed by his signature.  In the contract, the buyer may cancel the contract if they relocate the residence more than 25 miles from any school operated by Universal Martial Arts Center or its affiliated schools and that a cancellation fee due to relocation would apply, we also told Mr. ****** he would have to submit proof of relocation such as a utility bill, lease agreement, or dmv change of address in order to do an early termination of contract.

On 2/20/2023 ****** ****** sent an email saying he got a job in riverside and was not able to continue training because he had to relocate.  On the Same day, myself, ****** ******* replied to his email requesting a copy of utility bill, lease, that showed his new address and name as proof of relocation so that we could submit along with 30 day notice to cancel contract.

On 2/23/2023 instructor **** ******* sent ****** an email telling him we need something showing his new address to perform early termination of contract due to relocation, and that if he sent info from the DMV we could use that.

On 03/19/2023 ****** ****** emailed back said he canceled program that that he was not sending anything and that he was no longer doing the class and would not be paying, also said he would be talking to the police about Universal Martial Arts Center trying to force him to send information, said he would not send address period. ****** also said he would call the BBB and the police office to file harassments charges.

on 3/18/2023 myself, ****** ******* emailed ****** ****** back and again explained to him tat he is to submit a proof of relocation if he has moved more than 25 miles from the school. I told ****** ****** that is he was renting a room and did not have utilities or a lease to use as proof he could submit a receipt for payment which shows address for the new residence so that we could process early termination of contract due to relocation.  I also told ****** Sermin that no officer or agent Of Universal Martial Arts Center had harrassed him in any way and that we have only asked what is standard protocol for early termination of contract due to relocation, per his membership contract he signed that was explained to him at time of signature. Since documents had not been submitted the membership remained active, and I notified ****** ****** that any further contact with regards to billing has not been from us, but the third party company that manages the membership dues and handles all past due, bad debt, or return accounts.  ****** ****** was given the option to submit a copy of rent receipt and it would suffice to cancel account, but he refused.

All agents of Universal Martial Arts Center have been trying to assist ****** ****** in completing the early termination of contract due to relocation but it is him who has refused to assist us in canceling the account by providing information for early termination of contract due to relocation. We always aim to act in a honest and just manner and have always been transparent when it comes to members dues terms and how we apply the protocols across the board.
