The business called Tattoo **** owned by **** ******** was hired to run an estate sell at our house in *********. This occurred the first week of February of this year. Our agreement was that he was to take 35% of all proceeds from the sale and we would get 65%.1. On the contract that was signed by my sister he switched the numbers and inserted just the opposite that we would get 35% and he would get 65%. My sister signed this but missed the fact that he intentionally switched these numbers 2. The contract states he has 21 business days till he needs to show us detailed information on what he sold and pay us. We have yet to receive any information of payment and we are about 45 business days (more than 2 months) since the close of the sale. He must be doing these same tactics to many more individuals many of which are elderly individuals he is taking advantage of.

I am the trustee of the ****************** and ***************************** Trust. My sister ******* owned a home in ********* and I needed to empty the home to sell it. On or about 1 May 2023, a realtor that was working for me, *********************** contracted Tattoo **** to conduct an Estate Sale at ***** ***********, *********, **. *****. In the garage of the home was two cars that needed to be sold at the Estate Sale. An older Chrysler and a ********* We provided Tattoo **** with the Ca. DMV registrations and signed bills of sales for both cars, both cars were sold and one has been registered to a new owner. Unfortunately, the ******** has not and it still in the trust's name or my name. I have been calling Tattoo **** since July to get this resolved and the ******** is still not registered out of the trust's or my name. Tattooed **** assured me that he would get it done on 10 July 2023, but a call to the Ca. DMV today, 19 Sept confirmed it has not been done. I just need Tattooed **** to do what he said he was going to do, i.e., register the ******** out of the Trust's name.

On april 6th and 7th of 2023 I hired this company to represent my mothers estate. We agreed since it was so much stuff that the family would go through first before the sale and then after the sale to take what we wanted. Once the sale was set up we were told not to attend it would be easier for them to do their work. I agreed. Marks fee was 25% and this too was agreed upon. The sale took place on a Friday and Sat. the following Sunday, the day after the sale, we went to the house and it was near empty. I was thrilled. I took what i wanted out of what was left and then told **** the rest could be donated or discarded. Three weeks went by I texted several times inquiring about payment knowing it took awhile to settle receipts I was not worried. I then received an envelope that was overnighted to me with the receipts from the sale. To my dismay the entire estate and a car only brought to *******. I could not believe it. There were so many receipts that said Misc. 1 **********. My mothers estate had things floor to ceiling. There were no receipts for furniture or china cabinets no receipts for large items. I know he feels my moms stuff was not worth alot but we know what things bring on resale not even shops but garage and flea ****ets would bring more than this. When asked many many time to check revisit the sale he assured me this was it. I want to know what happened where did the stuff go? If donated show me proof. I know one of the cabinets sold he told me himself he had to deliver it. No receipt for it though? Months have gone by and still no resolve. We have complied a list of items and flea ****et prices of things not accounted for. Since there has been no resolve from **** I feel I have to take another direction before its to late. Please help me do this so this doesnt happen again. He was a friend of my mother I trusted him. I am very upset with the outcome. he says he has the receipts for the sale so do I so I will only upload if necessary.

Tattoo Mark held a 2 day estate sale at my house in Indian Wells. We agreed if he brought in more items I would receive the procedures. He said I didn’t have enough for his 1000s plus of buyers. We agreed his percentage of sales would be 25%. He agreed to close off my bedroom as I spent both nights of the sale there. All sales are final and he would leave my house clean. I signed a contract agreeing to these terms.

Tattoo Mark brought in mostly old items I would classify as junk putting in the back yard mostly which most of these didn’t sell. He filled two closets full of old clothes and put only a few items around my house and in the garage. The majority of the items that didn’t sell was his. I would say about 60% or more of my items sold the first day. Another 30% sold by the second day. I was there after each days sale ended so I was able to walk around and see what sold. After the first day of the sale he brought in some of his things outside as most of mine outside had sold. In the end I would say about 90% of my items sold.

It took Tattoo Mark a few weeks to get rid of what was left at the house but he did get most of his items the first week only leaving a few in the garage with my items that didn’t sell. It took Tattoo Mark 6 weeks to send me payment and invoices of sales. To my surprise only 38 invoices I received not even coming close to my items that sold and which I have inventory of. After bringing this to his attention that why only 38 invoices definitely not listing the majority of my items that sold. His response was I didn’t have many things to sell and he had to bring in items. So I said these are only 38 sales at your 2 day sale? He then said he kept invoices for his things and invoices for my things. This is not what was agreed! But I was mainly concerned about the nice items I had that were sold not his junk. 38 invoices didn’t add up! He continued to give excuses.

He did not live up to our agreement on many accounts.
