I am reporting a serious food safety concern involving a sealed can of Blue Diamond Whole Natural Almonds (6 oz). The product was purchased at ********* in March 2025. After consuming approximately half of the product, I discovered a visibly moldy, insect-damaged almond inside the sealed container. The almond was dark, sunken, and covered in a mold-like growth.While only one almond showed visible mold, Aspergillus flavus the most common mold found in almonds is known to produce aflatoxins, among other harmful mycotoxins, which are toxic, carcinogenic, invisible, tasteless, and heat-stable. These toxins can contaminate surrounding almonds even in the absence of visible mold, creating a scientifically documented risk of aflatoxin ************* Diamond acknowledged the moldy almond but provided no documentation that this batch had been tested for aflatoxins or demonstrated compliance with *** safety limits and refused further testing. Blue Diamond claimed that the kernel itself is considered defective, however, this would not affect the remainder of the contents in the can. This is scientifically incorrect. Aspergillus flavus the most common mold found in almonds produces aflatoxins, among other mycotoxins.These toxins can spread in surrounding kernels, especially in sealed, raw nut products. Blue Diamond also stated they cannot confirm whether I consumed moldy almonds yet this uncertainty only reinforces the legitimate concern for exposure, as I consumed half the can before discovering the visibly moldy kernel. It is unrealistic and unfair for customers to check every ******************** before eating from a ready-to-eat product.Despite raising these concerns respectfully, Blue Diamond declined to escalate the matter internally and shut down further communication.Business Response

This customer has reached out multiple times: email, ********, ******** comments all with the same comment.
She was provided with coupons (1 free replacement can a 3 $1 off coupons), which she accepted and printed as shown here: ***********************************************************************************. The kernel was a damaged kernel as defined by the **** and ***. We provided a clear explanation of these guidelines.
She stated she was seeking legal counsel in the matter and per our legal counsel, we were advised that we were no longer able to engage.

I am rejecting this response because:
Clicking a coupon link is not the same as accepting their explanation.
The link to the replacement coupon was auto-generated and shared before the company fully acknowledged mold. Clicking it does not mean I accepted their safety claims or resolved my complaint. A coupon for a free product does not address a potential health risk or consumer safety concern.
Their explanation changed after the fact.
Initially, Blue Diamond told me the almond had insect damage and was within **** allowance. Only after I pressed further did they admit that it was also moldy a fact with serious implications for aflatoxin exposure in almonds, which is regulated due to long-term health risks.
Additional signs of contamination were found.
After submitting my original complaint, I found three more almonds with black spots in the same can as seen in the attachment, suggesting that the issue was not isolated to a single "defective kernel."
I did not retain legal counsel I simply said I was considering my options.Their explanation is invalid and irresponsible.
*********** stated that the moldy, insect-damaged almond does not affect the rest of the can and that they cannot confirm whether I swallowed mold. This is scientifically inaccurate and dismissive of established risks. Mold like Aspergillus flavus, which is commonly associated with almonds, can produce aflatoxins invisible, tasteless, and toxic compounds that can spread within a batch during storage or packaging. Saying they dont know if I swallowed mold is not a defense its exactly why the issue should be taken seriously and investigated, not dismissed.
After they dismissal response, as a consumer facing a potential safety concern, it is entirely reasonable to explore legulatory options. I clearly told them that I did not hire an attorney, and the companys decision to cut off communication based on this is inappropriate and concerning.
Why I Am Continuing the Complaint:
My goal has always been to raise awareness of a possible consumer health risk involving a ready-to-eat product. Blue Diamonds respons has minimized the safety issue and offered no meaningful accountability or assurance.Business Response

Accepting the coupon isn't just clicking on the link. The coupons are only shown as printed when someone clicks "Print Now". We have provide all details regarding the product. As stated, to the consumer, almonds can have damage and the allowance is up to 2% per **** regulations. Damage kernels include mold and insect damage. We do understand the concern and have reported this to our ***************** team and as we stated we found no other report of any insect damage or mold with this lot code. We provided a replacement
We are not required to provide any testing or further documentation and do not provide due to proprietary information that these documents contain.

I am rejecting this response because:
First, I want to state clearly that I do not want the coupon provided. While I may have clicked Print, that happened before Blue Diamond confirmed the almond was moldy. After that confirmation, I no longer considered any coupon acceptable. Blue Diamond is welcome to deactivate it I will not use it under any circumstance.
Second, although **** allows up to 2% damaged kernels under visual grading standards, this does not address chemical safety, especially regarding aflatoxins which are regulated by the *** due to known carcinogenic risks associated with certain molds in tree nuts.
Given that my child and I have already consumed almonds from this batch, I am now respectfully requesting proof that the product I consumed was tested and found to be within safe aflatoxin limits.
Furthermore, I have preserved the moldy almond and its packaging and am willing to send the sample to an independent lab for aflatoxin testing. I believe it is reasonable and fair to request that Blue Diamond cover the cost of that testing.
The company claims no other complaints were received. However, I found multiple almonds with black spotting in the same sealed can, after discovering the clearly moldy, insect-damaged almond. I purchased multiple cans from the same lot, and my family had already been consuming them for weeks before this discovery.
This complaint remains unresolved. I am not asking for compensation. I am asking for transparency, safety verification, and for the company to take consumer concerns seriously.Initial Complaint

I purchased a blue diamond almond milk. The cap was broken and so was never properly sealed. I contacted the company with the lot, expiration date, date purchase etc. They apologized and sent a coupon for a free milk. However it only covered $3.99 of the $5.19 price. But I needed milk so I used the coupon. So now I have spent $6.39 on one thing of milk. I contacted blue diamond again saying the issue was not corrected instead I have just given you even more money for the damaged product. They replied saying they are not responsible for retail prices. I have sent 4 emails since asking for it to be made right. They have not answered a single email. Their product was damaged at manufacturing. I expect them to make it right. I just want to be reimbursed the $6.39 I have no spent on one carton of milk. It is unethical practice.
