The referenced link is from ********************, which is not an Enformion, LLC company.  Further, when you click the link, it says "This record is no longer available," so it appears the information in question is no longer available on their site.

This complaint is about the affiliate company ******. I assume Endato is wholly owned by Enformion because both websites reference each other. My complaint concerns my name and information appearing on their website when someone googles me. Both companies are data brokers, fine. I was able to get some of my information removed from both sites using the "Do Not Sell My Personal Information" links. Enformion removed everything. However, Endato refuses to remove "business directory information". I contacted customer service and this is their exact response: "Business directory information is sourced entirely from publicly available information and is not covered by the various consumer privacy laws. We do not currently offer the ability to remove business directory information."When I asked for clarification regarding the public source used for the information the response was: "All the information on our sources we are legally required to provide can be found in our Privacy Policy". This doesn't help me. I'm not sure what my rights are but deleting some information and selling other information doesn't appear to comply with the "Do not sell my personal information". Both tags attached to my name reflect city and state. That sounds like personal information to me. I just want my information removed and do not want my name to appear on their directory when I'm searched.

The various state consumer privacy laws, including the New York Privacy Act of 2024, offer various rights to consumers including the right to opt out of the sale of 'personal information". "Personal information" in the New York Privacy Act excludes "deidentified data, information that is lawfully made publicly available from federal, state or local government records, or information that a controller has a reasonable basis to believe is lawfully made available to the general public by the consumer or from widely distributed media", otherwise termed "publicly available information". The business directory information, or workplace data, the complainant is referencing is publicly available information sourced form various sources, such as workplace social media sites like ********, and therefor is not covered by the New York Privacy Act, meaning we have no obligation to remove from our products.

      Customer Answer

      Date: 01/26/2025

I am rejecting this response because it (1) contradicts your existing Privacy Policy and (2) causes your existing disclosures to be misleading.

Your Privacy Policys Deletion/ Removal section discloses the following: "With regard to content on our Endato Applications, upon request we can block the records we have control over in our database from being shown on Endato. [emphasis added] You can request for your personal information to be blocked from being searched using the link below. However, absent clearly defined terms for the meaning of personal information and records, your current disclosures are misleading and inaccurate. I submitted Right to Opt Out requests with the understanding that any records you have on me would be deleted and blocked from being shown on Endato but it appears you are not following your opt out practices as disclosed.

As it exists today, your privacy policy fails to clearly disclose that personal information excludes publicly available information sourced form various sources, such as workplace social media sites like LinkedIn, and therefor is not covered by the New York Privacy Act, meaning we have no obligation to remove from our products. Your privacy policy also fails to clearly disclose that you will not delete certain information. Therefore, I continue to request that you delete the information you have on me because as explained above those are the terms of your existing Privacy Policy.

My LinkedIn profile is now private and not searchable. Therefore any information you retain will be outdated and lack value so Im not sure what the big deal is.

I am writing to bring to your attention a serious matter concerning a breach of privacy and company policy by one of your employees, ***************************.************** has egregiously violated client privilege by discussing my personal and business account information with a third party, despite explicit instructions not to do so. I had previously taken the precaution of putting a code on my account, along with a note specifying that only I should be contacted regarding any matters related to my account.Despite these measures, ************** divulged sensitive information to a collector, resulting in the unjust freezing of my account. This has not only caused financial losses for me and my team but also disrupted the use of essential skip tools that I pay for.Furthermore, ****************** unprofessional behavior is evidenced by her attempt to open an account for a convicted criminal, *****************************, who has a history of non-compliance and credit card fraud. This raises serious concerns about the integrity of Enformion's operations and the protection of client information.I am deeply offended by ****************** actions, and I insist on immediate action to rectify this situation. I demand that my account be reinstated promptly, along with three months' compensation for the disruptions caused by ****************** actions.Additionally, I request a thorough investigation into the recorded conversations between myself and **************, as well as the interaction between ************** and ********************. These recordings will undoubtedly reveal the extent of the privacy breach and unprofessional conduct.I have attempted to escalate this matter by requesting transfers to *****************************, but regrettably, I have received no response or action. However, I received an email from the compliance department telling me my account is closed with no explanation at all. I urge you to take immediate action to rectify this situation by reinstating my account with compensation for the negligence by your employee.
