  I have no consent for anyone to authorize my signature to open an account with the original company Caverna. They sold the debt collection to a company which I disclosed it was a fraudulent account open. *** filed a complaint with this company and they agreed to remove this it has yet to be removed

  Hi,

  I am the owner of the company that this consumer has done business with.  However, the business that this consumer transacted with is our business center named Center 57 and not the ***** storage business (Caverna 57) that this customer has used when filing this complaint.  To be clear, this customer used virtual office services and not the wine storage services of Caverna 57.

  I personally opened this customers account several years ago, have a copy of her driver's license and know her well.  Over the years, she has been delinquent off and on catching up at times by using an entirely different payment method or credit card.  My staff also knows her very well and has facilitated bringing her account current many times.

  As I see it, there is no chance that this account was opened fraudulently using somebody else's identity.  What's more, Adrina's contract with my company included a Non-Disparagement Agreement, of which she is now in violation of.  The agreement contains a liquidated damages provision of $1,000 which we will now be billing and sending to collections should it not be paid.

  If this customer has any questions, she can call the office and ask to speak with the owner.  I will gladly talk to her again just as I have several times over the years.  Additionally, if BBB has any questions for me, they are also able to phone the office and ask to speak with the owner.  I will gladly provide any additional information needed.

  I am rejecting this response because:

  I have not received supplied proof under the doctrine of estoppel by silence,

  719 I May Presume that no proof of the alleged Debt, nor therefore any such debt in fact Existence in my name. 

  On July 6, 2025 I received a call from a business owner of the business. I immediately informed him that someone has been impersonating me. I have a complaint with the BBB filed 8 years ago when I first learned of the situation with the impersonation. I asked him on the call to describe what I looked like and I recorded the call, he said 55 brown skin heavyweight. Im only 49 extremely short and extremely skinny since birth.He made a racial joke about it. Im sure he would have remembered me if it was actually myself. 
  

  Furthermore someone obtained a card in my name which is also listed in the police report that I filled several years back. 
  

  I called the company listed direct on complaint and left a message she was allegedly out of the office. However, I had this phone number for four days. She gave him the information. At this point Im suspicious of fraud from both parties involved. I also Him and her are both in correspondenced with one another and they discussed my situation personally.which is totally inappropriate and illegal. I believe that they are related or friends.

  I hope you understand that I never made any contract with your company. Very sorry that someone would intentionally do that to you but Im a victim here. I also didnt give anyone permission to sign my name, on anything. As I stated its not me who you think you meet

  Hi,

  The telephone call referenced by the complainant did in fact, happen, but was totally misrepresented in her last stamement.  A review of the recording they claim to have will substantiate this fact along with everything that was mentioned in my original statement here last week.  I would encourage anybody reviewing this file to request a copy of the recording that the complainant claims to have.  You will find any such recording very telling.

  I suspect that this will be my last statement regarding this matter, and hereby refer any needed response to the collection agency mentioned by the complainant in their original complaint.
