    I purchased a Vitara refrigerator on 06/07/24. I have ****************** from the owner ************************* of this refrigerator with no signs stating sold as is so the purchase occurred & $1,831.24 was ***** to his wife *****************************. ***** dropped of the frig on my front porch & took my inoperable Samsun refrigerator which ***** told us he could not assist with plugging refrigerator in as it is under a one year warranty. ***** told us to not plug it in until the following morning. We did as told. This frig stopped working within 7/days. I sent a text to ***** expressing my buyers remorse w/disappointment that I wanted to return the Vitara frig. Immediately, ***** replied to my text stating NO, I cant return it due to one year warranty. ***** gave me a repair receipt that does not state Sold as is, but as soon as I asked for the sales receipt, ******* said she will email me sales receipt w/incorrect purchase date; incorrect email address under my name & she added UNIT SOLD AS IS IF UNIT FAILS CUSTOMER IS TO CALL MANUFACTURER. I immediately told *************** in a group text that this frig was NOT sold AS IS;that they are WRONG. I have pictures, first receipt stating SOLD FRIG on a repair receipt vs sales receipt & NO SIGNS in their business regarding this Vitara frig in their store SOLD AS IS. *************** should NOT be in business. I am upset w/myself for NOT reading all the poor reviews/comments re: their business as my intention was to help a small business with my honest integrity. They are **************** I am inquiring w/legal counselor to pursue a lawsuit, but because my faith & love for My Master Lord ***********************, I decided to let God lead me as Counselor & write this complaint. They hide behind the Bible stating have a blessed day yet they treat people poorly to gain financially from their customers. It is horrible that they get away with evil conduct!! Their reviews/comments speak for themselves. I will add one more to their poor collection.

    Although the unit is not working, she was told that it has a one-year manufacturer warranty with Vitara. Our policy is final sale not sold as is as I mentioned to ******************* that was a mistake I made, and I corrected it. We do have a final sale no return sign in the shop. She was told that if the unit had a one-year manufacturer warranty, but she had to call them and register the unit. I am confused because she states she did not receive a sales receipt only a repair receipt, yet she provided you with a copy. 

    Vitara is already working with her on repairing the unit. I mentioned to her if the unit would be deemed unrepairable ****** would refund her the money so she will not lose her money. ****** went out on June 24th we were told and that the fan was the issue in which they are repairing the unit. 

    She purchased an extended warranty which will take affect one year after the purchase date if the unit were to fail and even then, if unit is deemed unrepairable, they will do a buyout.  

    Please read the email that I sent where I explain more. We have not stopped communicating with her and we have even been in contact with ****** to make sure things get done. We are not ignoring her and are trying to help her.

     I am rejecting this response because:

    There were no signs nor was any verbal expressed from Manny and/or ***************************** verifying this Final Sale. No paperwork was signed by me as ***** had me sign a repair slip vs sales receipt. Why would a final sale be imposed w/this brand new refrigerator? I would have NEVER bought this expensive appliance purchase if it was a Final sale as this would have been a RED flag for me. I have owned eight homes so I am aware of buying appliances. 

    ***** & ******* are untrustworthy. The warranty rep from ********* that came to assess the issue asked who sold refrigerator & if ***** was a repair appliance tech, he could have told us that the fan never worked.  I have been without a refrigerator since 06/07/24 date of purchase as the freezer is keeping frig lukewarm. The repair receipt does NOT state Final Sale & why would this as this is a brand new item vs used as Manny may have manipulated this refrigerator & kept it looking as new.  I  was told from the Tekniton warranty rep that fan will be in on 3rd day if not sooner. I called ********* & ****** & no one can inform me when fan will be in at this time.  All my food spoiled as I do not have another frig at this time & the inconvenience of going out & buying food is expensive. I asked ***** & ******* for full reimbursement so I can buy another one which they knowingly sold me this frig w/inoperable fan. I am waiting for a reply for ****** regarding full reimbursement or delivery of a new refrigerator or I will seek legal counsel against *****, ******* & Vitara because they are ALL responsible!!

    ************* never came to our store I believe it was her husband that came so her saying that there were no signs of final sale is untrue. The sale price was $1631.23 the additional 200 is for the extended warranty she purchased. We do not have that money she would need to contact CPS. She states she does not have a working fridge since the date of purchase 6/7/24 when they were told not to plug it in to wait 24 hours. That tells us they plugged it in right away. This can cause damages. If her fridge was not working since the date of purchase 6/7/24 yet she contacted us on June 18th (have attached, her text message of when ***** went out). That tells us that the fridge did work for some time not as she states effective 6/7/24. What proof does she have that we manipulated the fridge and kept it looking new. We have proof that we bought it brand new from the distributor. 

    As for her food spoiling, she may ask ****** and see if they will reimburse her for her food. 

    She states that when the tech. that ****** sent that if ***** was a tech., he could have told us that the fan never worked. Again, how would we have known if we never tested the unit. If you look at the pictures, she provided is shows it had tape around.  

    We have no control of any appliance that we sell will not fail. We do appliance repair for ******, *********** and other companies and we go out and repair appliances that have been purchased within a week that do not work. They are manufactured in an assembly line, and this is bound to happen. The fridge will be repaired and as she stated if it does not then ****** will refund her the money. 

    The sad part is that the transaction was done with her husband not her so even if we say we told him she was never here so how do we defend ourselves.
