    I was enticed to a great deal by the president of this organization. Upon receiving a down payment, The VP changed the deal. The price doubled. They will not refund my money!!

    They are forcing me to do some online courses. I can’t believe they will deny a refund. Never did the online courses. Literally i did nothing on my end after the VP changed the deal.

    On January 16, 2023, Complainant reached out to SPCDL to obtain his Commercial Driving License (CDL).  Complainant stated he was issued a traffic citation for driving out of class while operating a commercial vehicle requiring a Class A driving license. Complainant spoke to the owner Joshua. Complainant stated he previously held a CDL and wished to get his "Class A" CDL back. Based on complainant's statement of having previously held a CDL, he would not be subject to 49 CFR 380 requirements for "entry level drivers". Complainant was given 4 options, 2 full days of 1 on 1 training, 1 full day of 1 on1 training, 1/2 day of 1 on 1 training, and paid hourly training. Complainant chose the 1 day program and was given a quote.  

    After registering and submitting a down payment at our training facility, Complainant was asked to submit a copy of his current driving license and permit. Complainant submitted 3 documents issued by DMV; test results, application for renewal of Class A CDL, and his Class C driving license. Complainant was issued a username and password for SPCDL's Learning Management System which houses pre-trip study materials which include written documents and videos.

    On January 24, 2023, at 7:49 pm, Complainant sent a text to SPCDL stating "His Brad, Im having problems with the audio on the learning course, which is making it difficult for me to listen to while driving. Is there another way; paper test question's. I drive for a living and would like to memorize the questions to move forward with the permit, Then go training with the instructor. In a couple of days I will be making another large payment. If you could help me out this way. I fell it will be faster for all. Let me know!."

    SPCDL learned that Complainant never held a Class A CDL and was subject to 49 CFR 380. Complainant  was advised and given the new quote. Complainant continued to operate a commercial vehicle without a proper license and was issued a 2nd citation for driving out of class.

    SPCDL has training records that show Complainant changed the passwords, as required, on the 2 LMS programs and accessed the learning materials. Because SPCDL incurs cost once the LMS programs are accessed no refunds are available. Complainant was told this while speaking to Joshua and Brad. There are numerous text exchanges to show Complainant actually began the program. Therefore, SPCDL cannot issue a refund.

    SPCDL offered a compromise of a partial refund however, Complainant rejected the offer and stated he wants a full refund.

    Copies of materials and communications can be made available if required.

     I am rejecting this response because: I have a number of emails form the school ( spcdl ) that say proves the fact. “You have mot started the courses” They would like for me to do so, so that can justify $1000.00 down payment.

    Complainant submitted documents that do not support the claim that training was not started.  Complainant accessed both multimedia Learning Management Systems, JJ Keller and Southern Pacific and changed the passwords which is required on the first log in. 

    Complainant completed 3 modules on JJ Keller LMS approximately 16 days after submitting the down payment. Pictures of the JJ Keller LMS attached which show the time spent in each of the 3 modules and passing score on each quiz. Complainant accessed the Southern Pacific LMS Permit Materials on January 25, 2023 and "Passed". Complainant accessed the Pre-Trip Materials on January 29, 2023, and completed 3 segments.

    All reasonable efforts to resolve this complaint have been made. Resolutions offered include but are not limited to, a refund of 1/2 ($500.00) of the original down payment of $1,000.00  and continuance of training and extension of time needed for final payment. Complainant rejected all resolutions.

    A document submitted by Complainant is the response by SPCDL to a 1 star review Complainant left on Google. SPCDL strives to respond to all reviews.
