    I signed a contract to purchase a heat pump system, attic fan, upgraded attic insulation and related services for my home from All Bay Insulation & HVAC *** in July of 2022. The contract work was performed over the next three months. A major inducement to me to enter into the contract were the repeated representations to me by various All Bay representatives that the system they would install qualified for the then existing 30% ************************** Tax Credit. I paid for the system in accordance with the contract and filed Federal Form 5695 to claim the credit on my 2022 taxes. In November of 2024 I received an audit notice from the *** demanding that I supply proof that the system qualified for the tax credit I had claimed in 2022 and I immediately requested the necessary documentation from All Bay. Despite my repeated telephoned, emailed and written requests for documentation that the equipment complies with the federal standards governing the tax credit All Bay has not provided me any proof of compliance nor, alternatively, agreed to substitute similar equipment which qualifies for the credit, and is ignoring the situation. The heat pump I purchased (selected by All Bay) was manufactured by *******************, a company that All Bay advertises particular expertise with, which makes All Bay's failure to stand behind its equipment selection, its representations as to the availability of the tax credit and its contractual and legal obligations to me even more troublesome. I have contacted ******************* seeking proof of eligibility for the tax credit only to learn that they do not have documentation for the specific model All Bay selected and sold to me although many other models Carrier produces are provably eligible. I am attaching a copy of the formal demand I made to All Bay to remedy this situation to which I have received no substantive reply leaving me without the documentation I need to substantiate the tax credit I claimed in good faith.
