    Fitzgerald & Campbell APLC ********************************************************************** ---****** ** ***** January 2, 2023 Dear Lawyers,I am POA (and sister) of *********************************, at the above address. ****** engaged you months ago to help her with her credit card debts, and after the original payment has been paying you $60 a month since July 2022. We have heard nothing from you since then. She engaged you only weeks before having a stroke, so I cant get much information from her. Now I am taking care of her accounts.On November 2, I wrote a note with the monthly payment asking if there had been any progress. I got no reply.On December 1, I sent you a letter along with the payment, and got no reply. In that letter I wrote you that if we didnt hear anything from you I would copy this next letter to the Better Business Bureau, and have done that here.Perhaps you are actually helping ******, I hope so. We have no way of knowing since you have had no contact with us. Or ****** could pay you the monthly fee for years without any acknowledgement or correspondence.So I am asking once again for you to contact us and let us know of your progress. You can respond to me by email at --- or by letter to ************ at --- or ************** at ----I will withhold Januarys monthly payment until we hear from you that it is actually being put to use. I have filed an official complaint with the Better Business Bureau. ****** really does need the help you offered. I hope youre on it.A disappointed thank you, ***************: Better Business Bureau

    Your sister first reached out to us in 2021 regarding three accounts that she was having difficulty with. She eventually decided to use our debt protection services (contract attached). As an elderly woman with no significant or otherwise attachable assets it was determined that there was no real need (or ability) to settle with these creditors. She did want us to stop them from calling her or otherwise contacting and harassing her. Accordingly, we were retained in June of 2022 to contact her creditors, advise them of our representation, demand they cease communication with her, and seek validation of the debts. This we did. We were not retained to settle these debts.  

    We reach out to our clients on a regular basis to see if any of the creditors have contacted them directly in violation of our cease & desist letters. We did this with your sister directly via the online portal we use to communicate with clients.Unfortunately, we never received a response, and it now seems we should have been reaching out to you directly on these follow up calls.

    Attorney ******************* states she spoke to you about what we had done and were doing moving forward. We did receive your November 2 note, but not the December 1 letter you reference in your complaint. Please accept my apologies for not reaching out to you directly at that time. We pride ourselves on great communication with our clients. Here the problem is we were reaching out directly to our client. We should have included you, particularly when your sister was nonresponsive.

    As far as moving forward, your sister can certainly terminate our services at any time. Just let me know how she wants to proceed.
