    Shorebreak Energy installed solar array system at our mobile home park which entailed boring underground trenches underneath the asphalt roads. The used a directional boring tool so the trench could be made without disturbing the asphalt road. 6 years later our roads are now caving in and sink holes developing over the entire run of their work. It appears a small 3" hole developed at the beginning of their dig due to lack of proper compaction which allowed rain water to seep in and slowly undermine the earth along the trench. This has led to cars collapsing into sink holes and cave-ins along the path of Shorebreak's excavation. This has been a huge inconvenience to our residents of the community and extensive cost to us for repairs. We have discussed this with Shorebreak and their representatives who have visited the damage but insist it was not their responsibility to repair.

    Shorebreak installed the subject solar system at the ************ Mobile Home Park (***) more than six years ago.  At the time Shorebreak installed the system,the ***s asphalt driveways were in bad shape (many cracks and gaps) and had inadequate drainage.  Accordingly, the origin of the problems identified by the complainant pre-date Shorebreaks work at the ***.
    Moreover, Shorebreaks work at the *** did not exacerbate the problems.  As identified in the complaint,Shorebreak utilized a directional boring tool to install conduit under portions of the driveways, and this technique was used so the trench could be made without disturbing the asphalt road.  In short, Shorebreak did not make any cuts into the asphalt, such that Shorebreaks work compromised the surface of the driveways and allowed water to seep under the asphalt.  Additionally, Shorebreaks boring occurred several feet below the driveways, using a compaction technique that would not produce gaps.  Thus, Shorebreaks work did not create any subsurface voids that would allow for the accumulation of water and sink holes.
    As previously explained to the complainant, the most likely causes of the sink holes are heavy rains experienced during 2022-23, the deteriorated condition of the asphalt, and inadequate drainage.  A further cause for the sink holes is suggested in a video recently shared by the complainant, which depicts recent excavation work within the ***s driveways and a flow of subterranean water entering into the soil removal areas. This water flow indicates a leaking underground water line or facility.  Whereas the conduit installed by Shorebreak does not convey water, Shorebreaks facilities are not the source of the water and, as such, Shorebreak is not responsible for the observed water intrusion or any subsurface voids / sink holes created by such water.
    Summary: Shorebreak did not cause the identified damage; hence, Shorebreak is not obligated to repair the damage or provide payment.
