I sought assistance from “tax expert” **** @ La Cumbre Financial Services for help filing my taxes years 2022-2024. He quoted me $600 total ($200 per year). **** was gracious enough to allow me to write a post dated check for final payment which we verbally agreed he could process once my quoted tax return was deposited in my account. The agreement felt great at the time and I was grateful that he extended the option for me to ‘pay later’ as well as relieved as he reassured me I would not be penalized for late filing and that I would in fact be receiving a healthy tax refund.
The day following this tax appointment, I received a voice message from his receptionist, stating my tax returns were rejected, as they needed to include my 1095 tax forms for all three years. I promptly provided these forms within 24hours and thanked his receptionist for following up. As a client who knows nothing about taxes and or all the proper and necessary documentation needed to file them, I continued to rest assured that the paperwork **** gave me was still accurate as I never received any call or email from him stating otherwise. Several weeks later, I received letters from the IRS Stating I owe thousands of dollars for 2023 and 2024.
I understand now, after doing my own research that the added 1095 tax forms drastically changed the outcome of my tax return information. However, this was never relayed to me by the La Cumbre Financial team or by **** himself.
Needless to say I swiftly reached out to **** to express my concern about the letters I received from the IRS as I was under the impression that something must have been inaccurate as I never received any updated information from him about any potential changes to the original tax paperwork he gave me.
He proceeded to rush me off the phone by telling me “ ya, you didn’t tell me you had 1095 forms so that changes everything. You can come pick up the updated tax paperwork and I will cash your check then!” I was quite stunned at the phone call because an explanation was never provided he simply implied that it was my fault for not providing said 1095 forms.
I followed up with **** on Friday 3/14/2025 and arranged to meet on the afternoon of Sunday 3/16/2025 as I wanted clarification. I called him that Sunday afternoon to confirm and he once again sounded rushed, it was evident that he did not intend to sit and discuss the details of my tax return paperwork or where it went wrong but rather, wanted to hand off my ‘updated’ forms so he could cash my check for payment. I did not feel comfortable with this because it had come to a point where I felt it would be wise of me to wait until I could arrange for an official meeting with him where I could perhaps bring someone with me who was more knowledgeable on this matter as it was beginning to feel that I was getting the run around. I explained to him that I would like to meet later in the week to discuss the situation in more detail and explained to him that I would feel most comfortable if he waited to cash my check until I have the Accurate tax documentations in hand. He agreed.
I texted him (per his suggestion to call or text his direct cell phone #) on Sunday 3/23/25 to inquire about the possibility to meet that day. He did not reply.
I then called his office today, 3/26/25 to speak with him to a) arrange a time this week to meet and pick up my ‘updated’ tax forms and b)explain to him that all this has been quite an inconvenience and that I would like to negotiate the amount in which he quoted me for payment as I felt it would be the right thing for him and his business to do considering the absolute lack of communication, follow up, and proper tax services that this business promised to provide.
I was met with the rudest response I have ever received from anyone let alone, someone whose service and help I was seeking. He proceeded to outright blame me for not providing HIM with the proper tax forms he needed to file my taxes. When I explained to him that I came to him, a tax professional, because I needed help and did not know what I needed to file my taxes, he continued to blame me. Stating that he was “not a psychic!! How am I supposed to know what tax forms you have?” “You can complain all you want, it’s not my fault that you didn’t bring me everything I needed” he said. I was completely baffled. I am a very sensible person and was simply hoping he would take some accountability and level with me, his client, and come to an agreement on a total that I could feel comfortable with considering all of this. Instead he advised me that I could bring in the (inaccurate)tax documentations he initially provided me, and he would then give me my new documents and cash my check. As I’m sure anyone in my shoes would, I rejected the suggestion to return the documentation he initially gave me until I had my updated tax forms in hand to review. He refused to give them to me unless I pay the $600. At this point I have absolutely zero confidence that any tax documentation he gives me will be accurate. Not only did he provide me with inaccurate tax forms and fail to promptly provide me with the updated forms for 2022-2024 but he also had me mail in my 2022 taxes which did not include my 1095 because his team did not ask me for this form until after my visit-so 2022 was filed completely inaccurately- when asked about this particular year and what I should do about this, he replied “I don’t know, you can figure it out yourself”.
It is dire that I receive accurate tax paperwork as soon as possible as my health insurance eligibility relies on this and I am at risk of losing coverage in the next week which directly effects my eligibility for necessary treatment I receive for my autoimmune disease. I greatly appreciate any and all guidance that you can provide on this matter because I am at a complete loss for words- I have never dealt with a situation like this and I feel completely lost and mislead on what actions I should take. For all intents and purposes I will add that this last conversation left me completely in tears as I felt overwhelmed with regret for choosing this tax service but mainly because I have never received such nasty treatment from someone I was seeking help from. I feel even more lost about my taxes now than I did going into this office.
