      On July 5th, 2023, this business was contracted by my son's property manager (I am a co-signer, and 100% financially responsible). They entered his apartment through an unlocked door, and was unsupervised. They billed for 10 hours of paint + labor + travel, for a total of $1300, of which was divided evenly between our unit and the one below (both 4BD units). They have said their work order was for "move-out" painting, which meant unoccupied spaces only. Apt unit below contained 3 vacant bedrooms, all requiring floor to ceiling paint. My son's apartment had only 1 vacant bedroom requiring the same. Due to the wall hangings in the shared common area (living spaces), they said they were UNABLE to paint - but insisted they still had equal 5 hours of billable work between units. When questioned how 3 bedrooms could take the same amount of time as 1 bedroom, the owner's wife retracted and claimed they DID paint common area walls and baseboards "when they could." I sent them pictures of the living space (she was not present to see for herself) to show there are no walls that would have been available to paint without moving furniture or wall hangings. There was also only a 2 hour window where no one home. Nothing was adding up, so I went to the apartment myself, and took pictures. No painting was done, yet the bill states "touched up unit where could, some areas received corner to corner where necessary" and dug their heels in that paint was done within the common areas, not just the vacant bedroom. This is a lie. I am submitting pictures from a walk thru mid-June (uploaded from a report, attached), and pictures from mid-Sept (attached) that 100% match. Smudge marks in the exact same spots on the walls. Not to mention there was never a paint smell, a note regarding wet paint, nothing. And they had 2 hours *** without being seen. I offered to send before & after pictures to resolve this, to which they said they "understand my frustration" and then stopped responding.

      Mark ********************** Painting, Inc.  received a work order from the ** to complete "move - out" repainting in several units.  In this particular unit  (Unit ****-***)  was intended to be empty, however it was not.  The superintendent of the job, for the **, was to not only instructed to unlock the unit for our painter but also to supervise duration of the painting because our company does not paint occupied units without supervision from a ** representative.  Once inside the unit our painter repainted the vacant bedroom, and bathroom along with touch up in common areas such as hallway and entry.   Our painter also touched up some of the common area that was accessible.  He did not however repaint the common area complete, as I was initially told.  The complete invoice is for two units,  **** #*** and #***.   Complete vacant repaint to unit *** and partial repaint of ***.   As I mentioned prior, the unit was intended to be vacant.  *************** was not charged the complete invoice amount of $1,***.00  in fact she was only billed 10% of the invoice in the amount of  $133.00  for the touch up that was necessary in common areas.  Unit  *** is a shared 4bd. 4 bath unit, the invoice would have to be split and shared by each tenant.   The invoice shows that we not only supplied man hours to do the work order but material and travel also.   We as a subcontractor, are not responsible for the cost break down and charge to each tenant through the **,  we are only responsible for the complete invoice owed to the ** for work completed.   *************** is suggesting that the work done to unit *** did not get completed, and this is false.  The repaint / touch up in unit *** did in fact get completed on July 5th, 2023.

       I am rejecting this response because:

      I have spent hours trying to resolve this amicably and factually. Aragon Painters is a family owned business, which in this case, has meant zero credibility. Their painters were NOT escorted by a GC. They entered an occupied apartment without supervision through an unlocked door. It is correct that I was only billed for $133 for common area repairs that WERE NOT COMPLETED, as shown in the attached before/after pictures.  So Aragon can refund me for $400, and I will pass down to my friends and family, or expect to have 3 more complaints filed through BBB from the other tenants. Either way, Aragon has lied, and refused to accept the facts. No painting was done in any common area in unit 300 - which was stated WAS done on an invoice by Aragon. Im Aragons response, they acknowledge there was only one vacant BD/BA - yet didnt explain why the invoice was equally split with another unit with 3x the number of empty BD/BAs. The invoice from Aragon is inflated. Refund the $400 total, which was how the common area was divided, OR expect 3 more identical complaints. Either way you slice this, the work you described & billed for didnt happen. The amount of time Aragon invoiced inside unit 300 is completely inflated and false. Pictures dont lie. People do!

      I read though all the pages and looked at the photos she provided.  Her photos do not prove that they were taken before and after, our work order was completed.   There is no date stamped on them, only the order in which they were saved and uploading to the complaint.   So that is not disputable proof that the work wasn't completed.  *************** specifically told me that she had NOT revisited the apartment after painting was completed on July 5th until September 1st.  So she is suggesting that no additional smudges, marks, or damage occurred after the repainting / touch up was complete.   In addition, our work order was invoiced directly to the General Contractor.  How the ** broke it down and divided among tenants has nothing to us.   We completed work, per work order request to the best of our ability.  Our painter was provided entry into the unit by ** and NEVER without permission.  Work order was completed without tenants present.  I feel like she needs to take up the amount she wants back from the ** as we were only subcontracted for the job.  She wasn't billed directly from us. Her issue needs to be addressed back to the **.

       I am rejecting this response because:
      My iPhone has a time stamp for the after pictures, so yes there is a way to prove when they were taken. Id be happy to have one of the tenants FaceTime you live as an alternative. I have offered to send video on any one of my many visits. The before pictures are from a document uploaded from a walkthrough in JUNE. It is not reasonable to suggest the exact same smudge marks, in the exact same shapes, in the exact same spots (PLURAL) are from new wear & tear. 
      Aragon has stated NUMEROUS times they are not allowed to remove items from the walls. Aragon was sent pictures of the walls covered with posters and other art to show that there is NO WAY any of the common area was painted without moving furniture or personal items. At most, the painter that entered unit 300 had 2 hours alone, of which Aragon stated that **** time frame included a lunch break. They have stated that they completed floor to ceiling paint, including baseboards inside a vacant bedroom and bathroom. From the limited 2 hour time standpoint - that alone limits the availability to paint any other room without being noticed. Also - there was no wet paint within the common areas when the tenants returned home around 2pm. I have a text from the ** telling the tenants the painter would be there a little after 12pm, and asked that the door be left unlocked. 

      I CAN prove Aragon did not paint any walls outside of the one vacant bedroom. Aragon CANNOT prove that they did!  I CAN prove that Aragon inflated their hours spent inside unit 300 because they logged the same exact hours for unit 200 that had 3x the amount of work. Aragon cannot justify their invoice based on the facts.  

      The before pics (taken by the **) and after pics match exactly. If Aragon doesnt believe me, request the ** verify and send his own pictures. The painter and the ** are either related or good friends anyway. The amount of nepotism is ridiculous. Family businesses = no accountability. 

      With regards to the amount of time between the supposed painting and when Aragon was first notified. NO ONE KNEW YOU BILLED FOR PAINTING UNTIL MID-AUGUST!  The tenants didnt know - because they never saw a painter. They never smelled fresh paint. They were never told to beware of fresh paint. Nothing was ever moved or out of place from being painted. The phantom paint job!!
