       I am rejecting this response because:


      The contract was a total cost of $32,000.00

      He never did the work on the yard and no date was scheduled.

      I am sorry for his part in trying to obtain business but that is what businesses do…..

      Why would someone want to keep my money when no service was done. 

      After I explained why I wanted to cancel should have prompt him to do the right thing and refunded my money.

      Hello,

      There are inaccurate details in this complaint. ***** **** contacted Husky Pavers in December 2021 for a quote and design for her backyard. In January 2022 we contracted for the backyard work. I had samples of various materials delivered to her for her approval, which she gave. In June 2022 we redesigned the project and a deposit was made. She requested a start date of September 2022 - prior to that, she had said she preferred a start date of September or later anyway. Between June and October she requested an additional design for the front yard, so I made a third trip and design consultation to her property. She promptly requested that we start right away. I told her that I needed her to sign the contract for the additional work, which she eventually did, and she requested a start date of October and mentioned that she was in mortgage forbearance and had to clear that prior to obtaining funds to do the work. Then she recently requested to cancel the project and have her deposit refunded. I declined to refund her deposit but rather hang onto it for when she's ready to do the work. She has strung our company along for almost a year with multiple site visits, designs and re-designs that, if line-itemed based on fuel costs and time costs, would be equal to or most likely greater than the $1,000 deposit that she made. Nowhere in the contract does it state that the deposit is refundable, and certainly not after so much front-end time investment had been made. I'm terribly sorry that Ms. **** is in financial distress, but Husky Pavers has not done anything wrong but rather is choosing to execute the contract that we have together. Ms. **** choosing to inaccurately describe her complaint and attempt to weaponize review services like BBB will lead to Husky Pavers pursuing legal action for breach of contract, defamation, and libel against Ms. ****. The inaccurate complaint she's already filed and any publications by BBB including her false statements will be used as evidence.

      Hello,

      Mrs. **** signed a contract in January 2022 and then placed her deposit in June 2022 when she requested a design modification. I told her that I would not continue to make site visits and design modifications without the $1,000 deposit that goes to****s my time and fuel for that. The designs were made - 3 total. 3 total visits to her home were made. In fact, there is a small ***ance due on the invoice for the designs and visits and a large ***ance due for profit and overhead that I am legally entitled to. I have made a very generous offer to allow Mrs. **** to cancel the contract without further cost to her. At this point, though, her deposit is forfeit as it went to****s my time and efforts and fuel for all the site meetings and design work. She is not entitled to anything whatsoever and finds herself flirting with several actionable items like breach of contract and libel.
