    Overpayment for project was sent and cashed by Willdan. ****** ****** Does not know the rules if refund can be sent back to me the property owner and emailed the bank she said . I was promised an answer would be sent today on 12/14/12. No response to email and no answer via her direct line . This is illegal holding funds due for over $3600 where the cashiers check was cashed over 3 weeks ago.

    Property Owner overpaid their payoff due to sending in an expired payoff quote.  The Trustee, by mistake, cashed the check, which should have been returned to the property owner.  However, since the check was cashed, the duty fell to the bank to return the overpayment.  This means the Trustee is the one who decides that the person/agency that paid the original check should be refunded the overpayment.  This is not a Willdan policy nor is it a ****** policy, but a bank policy.  Since the property owner would not provide Willdan with the name and address of the payee (mortgage holder), we were unable to give the bank the information to provide the refund.  The property owner insisted the refund go to him, personally, but the bank would not accommodate the request.  

    ****** has stepped in and will provide the refund directly to the property owner.  I believe the property owner has been contacted by ****** to arrange for the refund to be sent from ******, not the Trustee.  

    Willdan does not cash checks or have anything to do with refunds remitted to the Trustee.

    I have reviewed the response made by the business in reference to complaint ID 185**649, and find that this resolution is unsatisfactory to me.  I have not received confirmation in writing the loan has been paid off in full as requested

    We wanted to payoff our loan. The company is refusing to give us our loan number, a payoff amount, the name of the bank that own the loan. They are also trying to charge us a payoff quote request fee which was in a recent lawsuit with the FTC and the State attorney general in which California won the case. They have not been helpful at all on the phone. They told us we needed to go through a website to get the pay off amount and pay the fee, when. we tried the website was down and has been for well over a week now. When I called back they stated to "just mail the check in" and they will process it when they can.

    Unfortunately, our payoff quote request site was down and the property owner was unable to request a quote in a timely manner.  On November 15th a quote was prepared and sent to the property owner, free of charge.  On November 16th a second request for the same quote was requested and provided, free of charge.
