    J&A Enterprises, LLC **************************************** ************ ************************************ The above-mentioned Engine Repair Shop was contacted by us to provide an Inspection for a Boat issue (Shifter was a little stiff), we discussed the costs of Inspection over the phone and later on in person, and he confirmed it will take 1/2 an hour, with total inspection cost of $60.He asked for my address and my phone number for contact, which we provided, but no written documentation, estimates or disclosures of any kind was provided upon dropping the Boat to their shop on Monday 05/13/2024 at 10 :15 AM. We received a text message (available as evidence) from Mr. ************************* on the same day at 11:21 AM, providing us with four (4) pictures of his inspection findings. And followed by a phone call to confirm receipt and promise with detailed estimate, if we want to pursue repairs.Later on, that day at 2:42 PM, he sent us a written Estimate of $2,732.21 for potential repairs !!!We declined the repairs, and asked to pick up the boat immediately via text, he responded "it will not be possible today", we went to the shop the following day (05/14/2024) to pick up the boat, it was not there.******************** presented us with a huge Bill of over $426 alleging that it is "for his time spent on the Inspection", and he wants it in "Cash", otherwise he will keep our Boat !!Furthermore, he indicated that: "he drained the engine and ***** from oil totally and cut some major wires to prevent it from starting and shifting any more"!!! We did not authorized any repairs, modification nor alterations to our Boat at any time, just a $60 inspection (per our mutual verbal agreement).We refused to pay the bill at this point and indicated to him; "that is not a fair business practice to cease our boat illegally and damage it intentionally to force us into repairs that we can not afford, in a fraudulent attempt to generate an illegal income!"

    I was unable to upload the following directly to the BBB site.

    Customer set up an appointment. Customer missed appointment. Customer 'dropped by' with a boat to see if we could 'squeeze' him in. Looked at the boat while it was still hooked up to the vehicle. Customer was told to come back the following morning. Customer showed up at the appropriate time and was told that he would hear from someone in approximately ********************************************************* not, due to the customer's usage of the vessel in solely salt water conditions. Customer was informed and SHOWN the labor rate sign as well as the appropriate payment method. Customer was notified later that the unit had to come off the vessel and a detailed estimate was sent to the customer via text. The customer decided the repair(s) was too costly and asked if the boat could be reassembled. The customer was informed that in order to reinstall the outdrive; the shift cable would have to be cut. The customer agreed. The outdrive was reassembled NOT repaired as per the customers request. When the customer came to pick up the vessel the customer did not want to pay for the technicians time and offered to only pay $60.00; the customer was told no. The customer was informed once again, that our labor rate is $140.00 per hour and we have a three hour minimum (as the sign he was shown at drop off states).

    We, J&A, and the customer agreed to disagree. The customer was also informed while on site, and as per the work authorization that HE signed that a storage fee of $50 per day would take effect beginning 5/15/24. As per todays date (6/12/2024), the customer owes a $420.00 teardown and estimate fee AND $1,450.00 in storage fees; TOTALLY $1,870.00

     I am rejecting this response because: Repair Shop owner made multiple false and misleading allegations to cover up his track:

    1. No authorization was provided by us for tear down of the vessel at any time, only for $60 inspection fees.

    2. No authorization was signed by us regarding potential repairs, or any other authorization for "per hour charges".

    3. No authorization was given verbally, nor in writing regarding the Shop illegal seizure of the vessel/ fraudulent storage fees.

    4. The form provided by the Shop afterwards, it seems like it was written by the owner, included numerous erroneous information, and initialed in the bottom by him; signing his own contract, makes it null and void due to fraud.

    We will allow Ten (10) more days for the Shop to return our vessel in its original condition, alternatively we will proceed with litigation, seeking compensatory damages for the full value of the vessel, marine equipment, electronics, trailer and all other personal items left on board, in addition to attorney fees, court cost and punitive damages.

     I am rejecting this response because:

    Defendant was given multiple opportunities to settle this matter amicably but he refused.

    Our lawyer in the process of filing the case in court seeking damages and restitution.
