    On 12/31 the security company and RC towing *** worked together in towing my car at 1:30am. I was parked in guest parking with a VISIBLE parking pass. They claimed I was on my 6-7th violation when I do NOT live here. I am visiting from out of state and then claimed or HOA had made the call. The security gave no warnings and placed the paper the day of the towing. They placed two documents of the violation on the vehicle to make it seem as if I had a violation prior. We have not been able to get in contact with this company at all they do not want to even handle the situation and keep claiming they had nothing to do with it. Online theres a lot of complaints about how the *** security and RC towing company are working together to tow cars and gain money from it. Below I have provide proof of where I was parked and how it is visible on my car of the pass.

    On ******** *** ***** I was moving into my new residence at the ********* ******* and I parked against a curb to unload. My landlord and I were busy carrying a mattress up from the garage to the third floor unit. I was parked there for no more than ** minutes and my vehicle was towed. This was around **** *** As you can see from the attached photo, there is not a No Parking sign where my vehicle was located. I was not blocking any of the residents' garages or obstructing anything. I also had no intention of leaving my car there overnight. I had to pay an exorbitant fee of **** to get my vehicle back. I would like a complete refund and an apology for the inconvenience.

    Business Response /* (1000, 5, 2022/05/11) */ First, please note that we have referred this matter to our attorney and they will be reviewing. While it is unfortunate that the resident's vehicle was towed from the property, it should be noted that the vehicle was parked in a designated fire lane for the property. The location is private property and as such is governed by the HOA's parking rules. There is signage posted directly in front of where the vehicle was parked indicating that it was a fire lane and there was no parking. I have included pictures to show the area and signage at the time the vehicle was towed as well as during the daytime. As a contracted company we are tasked with enforcing the HOA's rules which is why this vehicle was subsequently towed. My contention is that the precise area where I was parked does not have a No Parking sign on it. There is a red curb indicating a fire lane behind where my vehicle was parked but not anywhere on the side of my vehicle. So the wall against which my vehicle was parked did not have a red curb or a No Parking sign visible. If you look at your photo in attachment 4, you can clearly see there is not a No Parking sign or red curb. I do understand that is not alright to leave a car parked in that area for long periods of time or overnight. However, I do not believe the HOA or FPK as its security designee should immediately tow a vehicle without warning. Since ********* ******* is a condominium complex, none of the residents have a private driveway to leave a car. Therefore, there are often times when residents need to leave a car for a short period of time, in a certain undesignated parking area for unloading/loading etc. As a I stated before, I was in the process of moving in and was going to move my vehicle 15 minutes or so after it was towed. The exorbitant tow fees charged by the HOA put a tremendous financial burden on me. I am a teacher on a limited income. I moved to the area to start a new job and was not going to receive a paycheck for over a month. I had to put the tow fees on my credit card and dip into my savings to pay it off. FPK and the HOA of ********* ******* are exploiting the residents with these outrageous tow charges when they already gouge every condo owner with a $300+ monthly HOA fee. I would like a refund for these charges. Business Response /* (4000, 9, 2022/05/15) */ Unfortunately the HOA parking rules are not up for interpretation from each individual resident. The HOA parking rules are outlined in the association's CC&Rs and that is what dictates our enforcement. The area that your vehicle was parked in is a dedicated fire lane as is the case with all areas behind the garages. FPK Security is the security vendor for the property and is not responsible for the actual towing of the vehicles. That is done by a separate vendor for the property. FPK Security has ZERO to do with the fees that are charged by that vendor. Any fees associated with the towing of the vehicle is set by the towing vendor for the property. While it is unfortunate that you are out these fees, there will be no refund issued on behalf of FPK.
