      I booked a taxi to pick me up and to take me to LAX at 6:30pm. I made the booking over the phone and was not told that there is a 15 minute window.

      I was not provided with any terms and conditions, nor was I sent a receipt.

      The driver then told me at 6:23pm that there was traffic in Oxnard (a very small town) but did not tell me he would be more than 15m late.

      Then at 6:33pm he texted me that he will be there in 15m, and that the terms and conditions require me to wait for 15 minutes.

      I waited until 6:45pm but the car did not arrive, so I found an emergency backup solution and left.

      The car was documented as arriving at 6:49pm, which the driver texted at 6:49pm saying they had arrived (19 min late). All of this is documented in writing by text.

      The person texting was arguing rather than apologizing for the lateness and being understanding. I then called and the owner, Ben, was yelling at me.

      I called Rosie’s Taxi, they said they would be there to pick me up in 15 minutes, I had a 2:00 o’clock appointment with a dentist in Simi Valley. 1:30 nobody showed, called Roasie’s and told them I have 2:00 appointment. She said he’ll be there in 5 to 6 minutes. 1:45 still no show so I called Western Dental I asked them my taxi was running late if it was alright if I was late. They said no, I have to reschedule called Rosie’s Cab back I have canceled because dentist canceled, she said they won’t wait and I said no they offered to pick me up on the next appointment, but I still had to pay again because they said I agreed.

      On 8/16/22 I submitted an online request on the rosie cab website for a Taxi ride from Fillmore, CA to LAX for 8/17/22 at 5:15 AM. The ride was confirmed and my credit card was charged in the amount of $179.09. I received a phone call a few hours later from their dispatcher claiming that they could not send a driver at the time I originally booked due to a shift and change and would need to arrive a full hour prior. The dispatcher stated a driver would contact me with a more accurate time. I received a subsequent phone call from their driver David who confirmed that 4:15AM was the only time near my original booking that a driver could arrive. I asked David if I would be refunded for canceling the service as my appointment time was now unavailable and he confirmed, yes, that it would be. We agreed that I would call him back shortly to let him know if I needed to cancel. I found alternate transportation and called David back to cancel and he again confirmed that I would be refunded. Within a few minutes I received yet another phone call from their now irate dispatcher claiming that David was just a driver and didn’t know anything and that I would not be refunded. I let them know I’d have to contact my banking institution for a resolution as they were now refusing to refund the charge for a service they did not render. Their dispatcher accused me of committing fraud at this point and I ended the call. This began a lengthy back and forth in text messages where their dispatcher again changed tone and began to offer a credit for another ride in lieu of a refund after continuing to accuse me of committing fraud and all but threatening legal action if the payment was disputed. This credit offer was presumably made because my destination was the airport and I would likely not return to claim it. It is my belief that this company has acted in bad faith, misrepresented their service availability on their booking platform, and are unjustly withholding my refund.
