      On May 02, 2019 my mother purchased a packaged HVAC unit with Comfort Now. My mother does not speak English, so I was present to translate for her. ***** *. was the salesperson and stipulated that the final amount of $8513.00 was for the entre unit plus a 12 year parts and labor warranty. This was the main reason we decided to purchase with Comfort Now. On October 20th 2022, I contacted Comfort Now due to a not cooling issue with my mother's HVAC unit located at **** ******* ******* I was told my the representative that I was outside of the standard labor warranty of 2 years and there would be a labor charge. I did not agree and did not have the warranty paperwork in hand, so I decided I would pay out of pocket until I could locate the paperwork. Later that day, the batteries were changed out, and the unit began working. I no longer needed Comfort Now come out to the house, so I called and cancelled the appointment. I told them that I wanted someone to call me regarding my contract. I received a call from ***** at Comfort Now on Saturday October 23,2022. I was able to send her a copy of the contract and she told me that there was nothing she could. The only thing she offered was we could back pay over $1000 and pay $20 a month for the warranty. My parents are both retired, living on Social Security, with my father bed ridden due to a stroke, this is something they cannot afford. The contract was marked and written that a 12 year labor warranty is included. The _____ next to the standard labor warranty is BLANK. It is blank because Jason told and wrote down that we have the 12 year labor warranty. There are four areas under the GUARNTEE section that have to be written in, the only one left blank is the Standard Labor Warranty.

      In regards to the complaint for ****** ********, I have attached the two forms of the contract and the invoice given to the customer and is in our files. The new system was installed in May of 2019. There is a standard 2 year labor warranty for the system which covers anything that goes wrong with the system in the first two years, no matter what it is, and it is listed on the invoice. On the contract it is clearly marked for the 12 years of labor warranty but states this is only under the 12 year labor warranty with the purchase of the No Worries Comfort Club for the entire 12 years. A customer can still purchase the extended warranty within the first year for $1000 and then begin the No Worries Comfort Club at $21.95 per month, which will need to be paid monthly on a credit card and automatically charged to that card for the 12 years. The No Worries club covers the two tune ups per year, which need to be kept up on to keep the warranty in good standing. The owner is willing to waive the purchase of the extended warranty and he will pay for that  and will allow the customer to start on the club membership at the $21.95 per month going forward for the rest of the 9 years that the labor warranty will extend to. Please let us know what the customer would like to do as the contract signed is a legally binding contract.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.  I would like a copy of the comfort club contract to *******************.  I appreciate Comfort Now working with us on a way to solve this situation.
