     I am rejecting this response because:

    This is to continue to bring to the prompt attention of the BBB, & Morgan Enterprise/***** Morgan; regarding my genuine concerns & resolution in an extremely urgent construction defect breach in my home that I am in contract on. I entered into this home contract, w/ my Realtor ************************* (Century 21), & Immediately provided my $2,500 ******* money deposit into Escrow w/ ************************* (Escrow Officer @ WFG ************************ I entered into this contract to extend my trust that I would receive a fit & finished, constructed to plan-code, & well crafted home by Morgan Enterprise. I am purchasing this home as a 100% disabled Air Force Veteran, & am extremely proud to be doing so on my own with my VA Loan. I am a 1st time home buyer; but have extensive knowledge with construction in my extended family growing up. So, respectfully, I am really fortunate I was attentive & able to catch these construction plan-code defects early on. I simply started the proactive, communicative & advocative process to request ***** Morgan to ******************* these issues. Everything has been email documented & immediately was addressed & brought to the attention of ***** Morgan, [as well as including everyone else: my realtor *************************, ********************************* (Century 21 Owner), ***** (*******), ********************* (******* ********************* Director), ************************* (Inspector), ***************************** (******* City Manager), & ************************* (Escrow Officer)], once I had to be the 1 to personally witness & discover my garage & patio were not constructed to fit & finish plan-code compliance (which I personally have provided to the BBB/& *************************** the pdf plans of my home, as well as my contract). I entrusted the licensed contractor to build my home to plan-code that I contracted into. The only immediate breach in contract was performed in these plan code violations by Morgan Enterprise. As soon as I started bringing rightful attention up about this to the proper & necessary chain of commands; ***** did not take that too well. & Rather than choose to resolve this matter with me in a concerning & professional manner, & with integrity as a licensed contractor towards his buyer; he just chose to instantly try & push my ******* money deposit back to me, in order to just 'dissolve' me from my future home.

    The original & only breach in contract issues were done by Morgan Enterprise/***** Morgan, & I widely documented, & addressed these genuine concerns. All that was requested is that he conduct the matter with integrity & correct the issues with the non-code compliant to plan code: (demo & reconstruct the garage with fiber mesh, & demo & correct the drastic non-compliant rear covered patio that had no footings).

    ***** had communicated & wrote in email that he "put my home on complete hold/pause until he would return from out of town the week of Sept. 11th 2023," to then resolve and address these construction defects when he returned. He did not do that or keep his word with me, & he continued to allow the ************************* to proceed immediately. He did not keep his word, communication, or integral trust on that concerning my home & addressing these construction mistakes with integrity. ***** just intentionally was dishonest & kept building the home upon, & right over onto both of these non-plan compliant code issues.
    Honesty & integrity is a vital part of maintaining your contractors license. Instantly offering my ******* money deposit back to me, & just trying to brush this & my concerns on these mistakes under the rug, & intentionally rather try to take the home from your Air Force Veteran buyer; this is not an illustration of integrity or genuine honest care. All I've asked for is a fully & properly inspected & well crafted home built to my plan codes that I entered into contract with. *****, please care about my home & me. I chose your home, & I trusted to choose you as my builder. I just want for you to make this right. I want to be able to move into a well crafted home from you.

    I genuinely & truly wasn't in breach of anything. There is no date on my contract for the 'upgrade deposit' *****. I communicated everything w/ you about my genuine concerns in the construction defects, & you said you would address it when you returned. I was awaiting that, & was awaiting the in person meeting with you, Century 21 *********************************, & my Mom; but you did not meet with me. I have been w/ my Mom from day 1 of viewing the model home, through purchasing into contract, & every single time I have gone to view my home she has been together right there with me. There hasn't been any breach of contract. Additionally, the immediate neighbor is my friend, & I visit her & have full view of ************* completely from her property & front yard. She witnessed 1st hand as well these construction defect mistakes on my home. Simply, all I have done is advocate for my home & myself.

    ***** Morgan has demonstrated freely by his actions, that he is more than upset that I caught these mistakes, & that it was unable to be just masked & brushed under the rug. This is my home, telling me I can 'have my ******* $ deposit back' is not a resolution, & it is not an illustration of integrity & care. ************************* (escrow officer), has been well kept up to date & informed from on my end, & she remains with my ******* $ deposit sitting in escrow still for this home I'm in contract on. I want you to please do the right thing, & resolve this with me ***** Morgan. I have been looking forward from day 1 of deciding to choose you as my builder, in hopes to see the end result of my well *************** home.

    *************************** entered into a contract for purchase of a home, contingent upon providing a required deposit. We began construction in good faith and sent a formal notice to ****** informing her that we had still not received ******* full deposit and that she was in breach of the contract. ****** was given additional time after the provided notice to correct her breach of contract, but she continued to fail to provide the deposit and correct her breach (Licensed Broker email attached). Furthermore, ****** harassed our contractors daily and interfered with the work, which is yet another breach of the contract that specifically states, ***** understands that in order to allow work to progress in an orderly fashion, no interference with the work may be permitted. The contract was later formally and legally cancelled due to ******* continued breach; ****** is unfortunately in denial of this fact. In regards to the two items ****** claims are illegal code violations, this simply is not true. Fiber mesh in the garage is an option and not required by any code or for any structural integrity reasons (an Engineers letter and a formal city approved plan change is attached to clarify). This was attempted to be explained to ******, as well as the formal approvals offered as reassurance, but ****** would not accept these facts. Secondly, the patio did in-fact have an error; this was immediately acknowledged and never hidden; ****** was assured that we agreed there was a mistake and that it would be fixed properly. The entire patio has since been completely removed and re-constructed from scratch this was always intended and was completed after ******* contract cancellation due to her breach (photo attached). Morgan Enterprise is properly licensed and insured and follows all formal city, state, engineering, insurance, and energy regulations, processes, and inspections in addition to our own quality control. ****** is simply upset that she cannot breach the contract and retain the home. We can provide further documentation, but the maximum attachment limit was reached... please do not hesitate to contact us for any further clarification and thank you for your time in reviewing this complaint.

    Nobody can purchase a home without paying for it. 

    ****** did not provide the required deposit needed to be able to purchase the home, simple as that.

    The home continues to be built properly - for whoever else purchases and follows-through with paying the required deposit - per Engineer's specifications and city approvals, along with all required inspections. If all professionals involved including but not limited to Structural Engineers, Architects/Draftsman, General Contractor, Contractors, ***************, and Insurance believes the home is being built correctly, what is ******** qualifications to state otherwise?  

    The required deposit was never received and this voids the contract - ****** was even given additional time to correct and still no deposit was received. ****** spent hours watching every contractor's move and is trying to fabricate normal construction process into "illegal code violations" as she puts it. ****** further interfered with the work and directly involved herself in the construction process on site (another contractual issue). ****** was even combative regarding one of her concerned that we said we would address - which was, in fact, addressed even after contract cancellation due to none-payment of deposit. ****** "reported" to the city who found no issues and approved the home to proceed. ****** is now filing this BBB complaint and wants "compensation" for "mental distress".

    It appears obvious that ****** did not intend to simply purchase a home.

    I haven't/wasn't in breech of anything. This is my home, I contracted into; that ***** Morgan breeched/failed to meet & perform my garage & patio construction to plan code compliance. I appreciate your genuine help & concern in this extremely important matter.
