    ***SUBMITTED BY THE BUSINESS-REQUESTING ARBITRATION SERVICES*** We have been doing work for him and his wife for about half a year and it has been nothing but problems. He doesn&#**;t like to do contracts and gives us a hard time about that. He is constantly trying to add more work that is not in the contracts and tries to tell us it&#**;s no big deal because the job is small. He thinks it is ok to yell and cuss when he doesn&#**;t get his way. This last contracted job he refused to pull a permit for. We took his down payment and had to special order his parts because they were back ordered. The parts didn&#**;t not come in the time expected but are here now. When **** told him we picked up his main part, ******** told **** that he was thinking of making some changes to the job. **** and I pushed the job further out because now ******** was now unsure what he wanted to do. As for us we do not keep the scheduled dates until the customer is ready for us to do the job. We are a small family owned business, we can not wait around for customers to make our schedules for us. ******** didn&#**;t communicate with us about his availability and now demands we do his work this Friday but we can not because of our responsibility to keep our schedule with other customers. We are not comfortable with working for ***************************************** because he will not take out permits when he should and when he is upset he yells and cusses at us. this customer has cost our business a lot of time, money and frustration with no resolutions. Please let us know if you need anything else from us.

    This is the most recent communication between **************************** and us. This is a text he sent us on Monday the 17th. We did not respond because we don't want to make things worse than it is. We are going to write him a invoice for all the work we have put into this job but he thinks he deserves a full refund besides for the materials already bought. All the time spent driving to and from his house per his request and driving all over Coloradoo to find a outdoor panel, all of this cost us. We are not sure how to handle this. We have already sent in some info to the BBB about this customer and this is just ridiculous.

    "Good morning. I think it is best for both sides to conclude this matter in a friendly manner as soon as possible. You may bring all the hardware you have acquired for this contract along with specific store invoices ( not an artificial invoice from you). Then you can deduct that amount from the $1,500 deposit we had provided and you will Venmo us back the remaining amount. You have been fully paid for every minute you have worked here already. So there is no question of any other oustanding amount. Once we get the proper balance back by Venmo or cash, we will execute a mutual paperwork saying that both sides are even and the matter is fully settled. After that we will part amicably. However, any attempts to extract any more money from our deposit amount will escalate this matter to the next worst outcome, and so on.

    DMD takes the position that we no longer want to work for this client. This client is very belligerent speaks down to employees including my business partner. We have accommodated this client by doing things outside of our contract helped him move into his new home helped him move his furniture around on weekends stuff outside of the scope of the business that we do we did to be kind to this client and help them out. We have put a lot of time and effort into tracking down his materials to do the work that we have done for him in his old home and his new home. We will at our convenience deduct everything that we have spent on material from the **** owed on contract and reimburse him the balance this will take place over the next 30 days. This clients belief system is that they are the only people we are supposed to focus on we have other clients and other work and they have tried to interfere with our scheduling again we have accommodated to the best degree that we possibly could as a company. DMD also takes the position that we will not bad mouth his business or his wife's business we will resolve this issue as stated within the next 30 days. Owner of DMD.

    I am rejecting this response because:

    Our position is that the Contractor is relying on fact-distortion in an apparent attempt to keep back as much of our deposit money as possible after failing to perform on the contract in question. As a factual background, the principal of the contractor came to us as a handyman first, seeking to help us fix up our old place for sale. There is nothing earth shattering about that; he came in as an hourly labor and helped with miscellaneous tasks that are associated with a standard house moving episode. Not sure why he is trying to insinuate that we made them do a lot of inappropriate things as if we had forced them to do those tasks or that he did us some great favor! We paid in full for every service performed and for every family member he involved PROMPTLY!!  ALL of this work was done on an hourly basis or contracted jobs and none of those tasks are ANY part of the CURRENTLY disputed-contract, or any other contract whatsoever. So, I am not sure of the reasoning behind raking those tasks up in relation to the contract in question, except may be to try to find a way to keep some of our deposit money.

    On the other hand, we had certain reasons to be weary of some of their performances, ********, and methods of operations. That is the sole reason we specifically wanted them to do the electrical box replacement work under a contract the contract on which they have failed to perform. Since the contract was not performed upon as agreed, we simply want our $1,700 deposit back in full.

    In closing, while I will not dignify their attempted character assassination efforts with any direct response, I will state that we have treated these people with decency, and overall the relationship had been quite civil until the very last conversation. The issue that was irksome was them unilaterally changing the timing for completing our work AT WILL, on SEVERAL OCCASIONS. That is why we took a position with respect to the contracted work that they must come and complete the work on the day they had committed to, or we will want our money back. That is where we are today. The rest is fluff.

    DMD has taken the position that we will no longer entertain this customers belligerent downgrading attitude towards the work that we had done for him and any future work that he wanted us to do he has openly lied on the complaint and belittled us from a construction company to handyman nothing was ever good for this client it was always something else needed to be done always got a little bit more out of us we bought material for this job this man pushed us off because he went out of town at this point now we can proceed to court I will no longer entertain any more of his statements or complaints he is desperately lying in a very ignorant way. The man treated us like we were the help and that we owed him something yelled and screamed and lied to us while working at his house never wanted to sign contracts always wanted it off the books we absolutely would not ever work for this customer again and in the future proceedings we can just go to civil court.

    There is no point in trying to respond specifically to DMD's last message; they are not interested in refunding our money. However, the message finally makes it clear why the business had been taking the approach of trying to assassinate our character in the last few interactions - they either: (1) Do not have the money to pay back the required $1,700; or (2) They assume that by trying to assassinate our character, they would somehow earn the right to not return the deposit money after failing to perform on the contract as required.

     

    It is very disappointing that reasonable disposition of this matter could not be found, despite the nice platform set up by the BBB. I would like to thank BBB and its staff for their efforts.
