    I hired ***************** of Yardmaster to build a fence around my back yard. He first sent me an estimate in late April. Most of our communication was done via text. ************** continually missed agreed upon deadlines and while his first estimate asked for 1/2 the money up front, I agreed instead to buy the materials with the agreement that he would pick them up and deliver them to my house. The project was stalled several times due to ****************** missed communications/appointments until finally on/near Memorial Day I texted and said we either needed to get the project going or give it up. He wanted a deposit up front to rent a truck and an auger and then promised (on at least 2 different occasions) that he would be here to cement the holes but then cited health issues or mechanical issues to excuse why it wasn't done. On June 15th I got a text using the same number from someone purporting to be ***'s son saying that he was on the way to the hospital after having a heart attack. I responded that I was very sorry to hear that and hoped ************** was able to make a quick and smooth recovery. I also said that I felt it best that he return my deposit and we could start again once he was feeling better. Later that evening, I got a text (from the same number) purporting to be ****************** ex wife thinking that my message was in bad form but that they would return the money somehow. I am seeking to get my $1000 deposit returned since he was not able to carry through with the project in any shape or form. I have no idea if all of what he told me was true, if none of it was true, or if some parts were and some were fabricated. I would just like my deposit returned to me to avoid legal issues.
