Attempting to sell a car thru PEAK AUTO AUCTION.I was attempting to buy a car thru the *********** for the car up to *****. Someone else outbid me. Week or two Later I see the car being sold AGAIN. This would mean whatever business they running seems like a Fraud or Scam where they can have an employee to bid for it to raise the price of the car so they Milk more money out of it. Why would someone outbid me and then have the car be sold again on the auction.Business Response

As stated, the customer has questions about PEAK AUTO AUCTIONS. Maybe ****************** can answer questions regarding how the bidding works. Peak handles the auction for us. However, while the auction is live, customers bid on the cars. Once the auction is OVER, the WINNING bidder must then PAY for the car. As this customer experienced, whoever won the car they are talking about (I'm not sure which car, as they did not provide that information) did not PAY for the car that they won in the auction. ****************** reaches out to the winning bidder, emails their invoice to the email on file, and also calls and texts them multiple times to attempt to retrieve payment. Unfortunately we cannot FORCE people to show up, pay for and take the vehicles that they won in the auction. Therefore, our next step is to just re-run the car in the next auction.
The customer was more than welcome to reach out to us and we would have answered these questions. We also have customers who ask us all the time to let us know if a car is not picked up, so we can reach out to them directly before rerunning them in the next auction.
Let me know how we can help

My vehicle was involved in an accident with another vehicle on 10/17/24 in ***************, **. I was coerced to go with this towing company. Police and tow truck driver multiple times said I should have my car towed (it was not drivable) to their lot in ***********, **. I wanted my car to be towed to a local shop instead as it would've been a lot closer. Under duress I had the tow truck driver take my vehicle to ***********, **. I never got a verbalization nor a written copy from the tow truck driver that there would be additional daily charges for as long as my car sat on their lot? I found out after 3 calls on 10/17/24 that they charge $46.08 per day. He did tell me the towing charge would be about $279 per hour. I spoke to a manager, *****, and they are not forgiving of the daily charges even though I wasn't advised, shady business. She found out maybe from truck driver or police that two of my airbags deployed on passenger side and she indicated this generally means vehicle is totaled. If they knew this information beforehand, why did car have to be towed to their lot? I just don't understand. I can't pick up my vehicle today, which was an option by *****, because my husband is out of State and I have no way to pick up my vehicle. Wondering if anyone else experienced similar issues?Business Response

Our driver and the Police were on scene with Mrs. **** for over 30 minutes while she tried to decide where to tow her car. The entire time her car was in the middle of the road at an accident scene. She finally decided on a shop to take it to, which was closed. So at that time the police told her she needed to get her car out of the road. She had full coverage insurance and her vehicle was obviously totalled. Usually in those circumstances, the insurance prefers they come to our storage lot, where the insurance picks them up and takes them to the salvage lot. Since Mrs. **** had full coverage insurance, she did not pay for ANY of the towing charges out of pocket. It was all covered by her full coverage insurance. her insurance picked the vehicle up from Westside, with no complaints.

I am rejecting this response because: First of all, interesting it takes a business to respond over a month later. Is that the norm? Whomever wrote the response above is being very evasive of my initial complaint. I do UNDERSTAND fully that my insurance had to pay for it all. That was NOT my inquiry. My inquiry was the fact that the tow truck driver, neither verbally or in writing, told me there would be a fee for every day my car was in their lot. I don't care who paid for it or not, that's not the question. I also wrote a complaint on NEXTDOOR that their services should not be used for this reason. I also told the tow truck driver that I could have my car towed to my home which would've been much closer for me than going out to *********** but that wasn't even an option. I guess I'll know better in the future to ask those kind of questions. Because this information was not expressed to me either verbally or in writing, this might be an indication why car insurance is sky-rocketing in *********You don't have to keep me posted any further. This is the last correspondence from this company that I'll no longer use anyway in the future. If companies, such as this one, were on the up and up, then they would freely divulge everything, don't you agree?
Sincerely,
********* ****Initial Complaint

Went to the towing company to get personal belongings ******* and ***** were really rude up front and said we can not go collect all our stuff because we werent paying there and then for the service of picking up the vehicle.Business Response

This accident happened on 7/23/22 at 4:43am. It took a heavy wrecker as well as a flat bed to recover as it had rolled on a mountain road. When they came in on 7/29/22, they had no proof of ownership. I have the Impound report attached from *****************************. We have a contract with ******* County Sheriff. It clearly states on there that it is required to have Valid registration and Proof of Insurance to retrieve property and release the vehicle. They said they did not have insurance at the time of the accident. They also said the proof of ownership was somewhere in the vehicle. I asked them what they planned on doing with the vehicle and they said "I don't know". I explained that the bill was over $2000 and does accrue daily and that we would need payment of some sort. We allowed them to the vehicle at which time they were supposed to get the paperwork to show they owned the vehicle. They asked if they could take their computer and wallet. I told them they could but I would still need to see proof of ownership. After standing out there for approx. an hour with them looking through the vehicle and taking multiple items out, (a wood box, phones, computer, many papers) they still did not give any proof of ownership to me. When they were done collecting, I asked them again for proof of ownership and they said they couldn't find it. I asked them again, when they were going to be able to pay, as i didn't want the bill to keep raising on them and they said they don't know. I told them that if they did not pay, upon ***** days the police agency will sign the vehicle over to us to be disposed of as it would be considered abandon and the bill at that time would go into collections. They were supposed to come back with their mom and said she would pay. They never showed up again. I do have a "property release" as well as a "promise to pay" with *********'s passport and signature attached. I am required to run vin searches and send certified letters to registered owner and any lienholders involved between **** days of being in the impound. I sent those out on the 7th day the vehicle was in here. I have also attached an invoice from today 8/25/22 for what the charges are currently on the vehicle. ******* County is scheduled to sign over the vehicle 9/7/22. We followed every rule per ******* County Sheriff as well as PUC regulations and rules.
