My mother passed away April 22, 2021. The person who runs this business, *************************** is a close friend of my sister. She was appointed by the court as the personal representative of my mother's estate. I have been homeless since February 14 of this year after ***** sold the house I lived at that had belonged to my mother. ***** said that my sister, brother and I would be getting our 1/3 share from the properties my mother owned that were sold. I was in a car accident in April of this year that I had a slow recovery and I tried reaching out to ***** through email to receive my share of the the estate and provided a mailing address along with how much the properties sold for and other money that was supposed to be equally divided. Never received. October 9th she had left a message saying she wanted to get the estate finalized and have the checks sent to my sister, brother and I. I found out through my brother she went on vacation on the 12th of October and I have tried calling her repeatedly before and after finding this out and she has been unresponsive to my calls and sending the check and this has caused me severe hardship. I am about to lose my storages because I was depended on receiving this money in a timely manner and this should have been settled months ago and she has dragged this out even after I tried reaching out to her in July. She filed as the personal representative under her business since this is something she does for a living. She also has this business filed with the State under *********************************, LLC and her entity # is *********** with the State. There is other instances of her being unprofessional. All I am wanting is to receive my fair 1/3 share that is legally mine and this has now caused me to believe she is trying to defraud me and also my brother out of our share. My sister does not even respond to either my brother or I. ***** has not given me what information I have requested that she is supposed to provide to me under the law.

      Business Response

      Date: 11/28/2022

I was appointed Personal Rep in the Estate of ************'s mother.  This has been a complicated probate estate from the beginning, mainly in large part due by ************'s actions and refusal to cooperate.  All of the beneficiaries were made aware of the complications and the need to administer the estate in a methodical and thoughtful manner.  If I had rushed through and closed the estate prematurely, there would have been problems that could have negatively impacted the beneficiary's shares of the estate.  I am sorry about ************'s current financial situation, however, I must perform my fiduciary duties to the expectations of the Court.

I have explained, on multiple occasions, the status of of the estate and assured ************ he will get the documents supporting his share of the estate once they are completed.

      Customer Answer

      Date: 12/06/2022

I made a complaint against Advocacy Guardianship Services, **** in regards to my mother's estate. ***** had responded back and I was given the option to either accept or reject her response. I had clicked the reject and when I went to write my response to her, it was so small that I had a hard time seeing what I was writing since I was doing this on my cellphone and it couldn't be enlarged. I had to wait to finish it. When I came back on to finish my reply it required a password that I was never given so I could not complete my response and it caused me to lose what I had already written. Now, when I try to dispute what she responded with, it does not give me that option and says she made a good faith effort and now it's closed.

The houses were sold at the beginning of the year and it has almost been a year. I have tried many times to reach out to her and she has never explained anything to me, never has responded to my emails, calls or text messages. I am not the only one who has had these difficulties with her. She has not provided me with documentation of the sales of the properties or provided any other information I have requested which is my right to have. I have spoken with three different lawyers in regards to this matter of not receiving what I have requested or receiving a check. They have said the same thing, that it is my right to receive those documents and she has taken way to long to send out the checks to my brother, sister and I. This should have been settled months ago and not have taken as long as it has. It had to take my brother taking me to her home which is also listed as her business address to get a response from her and for her to hand over money that my mother had in her storage to me. I had tried many times to call her and she would not answer or call me back leaving me in the dark. She never informed me by leaving any message or txt that she was going on vacation, knowing that the situation was not finalized with the estate. ***** stated to my brother and sister that her tax person had to do the taxes on the estate in order for the checks to be sent out to us and this was in the first week of October and it is already December. This is something else that should have been taken care of months ago according to the three different lawyers I spoke too. I've already been told I could file motions with the court without having to have the costs of hiring a lawyer that would do the same thing to have her answer as to why she has failed to get this done sooner.

***** started acting as the personal representative before she had any legal right to do so I'm which raised concerns with my brother and me. My brother was not wanting her as the personal representative from the start. I only accepted her because of my sister since they were good friends and related to my brother in law. There was doubts about her since the beginning when she knew my brother had stole my car ramps and she stated that I should just let him use them for the time being and that was unprofessional of her to tell me that, but I let that go for the time being and started noticing different things with her that made me uneasy about her. For one, not listening to anything I said and not talking one on one with me like she would with my sister. There are several problems that both my brother and I have had dealing with *****. It was our mistake to accept her as the personal representative when she clearly showed favoritism towards our sister.

      Sincerely, *****************
