      ********* ****** *** is the parent division of DreamMaker Bath & Kitchen located at *******************. I signed a contract in June 2022 to have my master bathroom renovated. The contract stipulates 50% (which for me was over $15,000) is paid up front to schedule the job. ********************************* - the owner- worked directly with me in the planning and signing process. The check was cashed immediately and after 6 months, I heard nothing. Early January came around and I called to check on progress. ******* got on the phone and said something along the lines of:" Your ears must have been burning. I just got finished interviewing someone I think will be good on your job. I hope we can get started on your bathroom next week." I called back on February 7th because no one showed up at the house and I had not heard any updates. ******* talked to me on the phone and said he was still working on finding someone to do my job but didn't have a start date. On Thursday, February 8, I left a voice mail to which ******* responded on the 9th that he had received and was planing to call after he "gathered some information". I present at the business on this day. ******* is not there. I ask if materials have been ordered. No one present in the office knows. ******* calls and using his office manger's phone. I talk to him. The conversation goes like this: "I never said I had anyone to do your job; You signed a contract; I can't give you all your money back; I can't give you the receipts for the purchased materials; Covid is causing problems with finding people; I thought about coming out to do the job my self - maybe next week; We just need to do arbitration then". I asked for the return of the entire amount I paid him to do a job he is not doing. He refused. I asked for my file. They refused to give it to me. I left. Less than 10 minutes later, I get a call from a police officer stating ******* does not want me at the business and if I show up, I will be charged with trespassing.

      ****************** contacted DreamMaker Bath & Kitchen Feb.2020 to design and remodel her bathroom. Her bathroom was partially demoed from a flood that happened sometime before she contacted us.   We designed the bathroom and when it was time to sign the contract she decided to hold off. At this point we had invested approximately 80 hours working on her design and proposal. I told her that is not a problem and to let us know when she is ready to proceed. She came back to us about a year ago and we redesigned the bathroom because she wanted to make some changes. We signed a contract for the work in June 2022.  We let her know because of the material delays and work load increases due to COVID the job would start in 6-8 months.  I made contact with ******************* in early January to let her know we are getting close to being ready to schedule the project. ******************* reached out to us early February to check on the status.  I called and texted her to see when a good time to meet was so we could determine the start day for the following week. She texted me back giving different times that would work. I picked one of her suggested times and texted her. I didn't hear back from her.  The next day, ******************* showed up at our showroom demanding a full refund and insisted that our office manager write her a *****************. My office manager called me immediately and I asked her to pass the phone to *******************. I calmly  tried to work with her to either give her the special order materials that had already been purchased and the balance of the deposit or allow us to remodel her bathroom starting the next week. She refused both options for resolution, so I let her know I would have to contact a lawyer for advice on how to proceed.  She exhibited inappropriate behavior with the office manager which necessitated a call to the police.  I arrived to meet both the police officer and ****************** but she had already left before I got there.

      I am rejecting this response because I have not seen any of the materials that were allegedly purchased for my job (*********** or at my house). I have not received proof that said materials were ever purchased either . I have never received s start date. I have been the only person to initiate contact with the company regarding work needing to be started and completed at my home. ********************** has always found a reason to deflect accountability. Even in the texts Ive included, I dont receive a solid explanation about anything. These texts were written after I called and left a message asking for a specific start date and procurement of materials for the job and I still dont have an answer.

      The materials for Mrs. ******** job are here in our warehouse and we have receipts that shows they were ordered and delivered to us over the last 6 months.. During the phone conversation on 2/16/2023 I told ******************* that we were planning on starting her project the following week.  At that time she said she was unwilling to let us complete her remodel.  I then offered to give her all the materials (since these special ordered items can not be returned) that were ordered and refund her the balance. She refused that offer also.  She insisted on a refund for the full amount.

      I am rejecting this response because Dreammaker Bath & Kitchens is still unable to provide a solid start date for the work to begin - after over 8 months of waiting on my part. They have also failed to provide any written documentation of said purchased materials for the job. This is easily remedied by using ***** email, text messages, etc. At this time, the only person who has proof of holding up their end of the contract is me. I am requesting the $15,125.65 returned to me so that I may find a contractor who is willing and able to complete the job they contract to do within a reasonable timeframe, in a reasonable budget, and with integrity. I have included some of the emails ********************** and I exchanged after he called the police on me. In the exchange, I offer options for him to either complete the work or send me a wire of the complete refund. ********************** gave no direct response to either option. This tells me he has no intention of completing the job or refunding me. ********************** has made it very clear he would rather pay for arbitration instead of admit he has no way of performing the duties outlined in the contract he signed. I feel taken advantage of. I would like my refund.
