    I cancelled the fence contract, on Friday the 15th of July, 2022, with Spartan Fence Company as they failed to fulfill their obligations. They hadn't shown up on 3 different scheduled occasions. They failed to communicate with me as to what had happened until I contacted them, (****), after each occurrence. Original start date scheduled, 7/11/22, at 9:00 AM, crew not only was a NO CALL-NO SHOW, but I had to contact ****, 2 hours after the scheduled start time, to see why they didn't show up and why I wasn't notified. **** said it was due to the high winds on I-25, and that the crew turned back. **** said in another text, that they would be out the next day, Tuesday, 7/12/22. Again, NO CALL-NO SHOW, on Tuesday the 12th, and again I had to contact him to see what was going on. **** explained that the previous week the crew had guys sick for four days.**** said that his crew could be here on Friday, 7/15/22. I agreed, providing they complete the job by no later than Saturday the 16th. He assured me that he and the guys would be here on Friday and Saturday. **** said to expect them here by around 10am. Again, NO CALL-NO SHOW on Friday the 15th, 2022. I then contacted Gar via text at noon, 7/15/22 and let you know him that I was not pleased and I cancelled the contract. I also told him how expeditiously I paid him the $2500 down payment through the Cash App, and that I expected him to send me my refund immediately. His response was, "I'll work on that this weekend." I sent **** a text on 7/15/22, and I explained to him that I had been exceedingly patient and that he should have the common curiosity to refund my deposit and that his timeline for refunding my deposit was unacceptable. By Monday the 18th, **** still had not refunded my $2500 deposit. I sent him an email and told him I needed my $2500 by end of business today, or will be contacting my attorney, turning this into a legal matter. His reply, "Youll be paid, no need to get a lawyer".
